One interesting bit is that they offered him accommodation on the ground floor but he chose to share a room upstairs.

His choice, his consequences...

Exactly. Usually to the sum of $5 million.

If a parcel delivery person trips on your crooked pavers and breaks his ankle, he will sue, and rightly so. That's why we have it.

he is suing their insurance company....thats why we have insurance....accidents do happen in people homes....

Don't tell me you've actually read through the
small print
on your 102-page NRMA Insurance Policy Brochure?

You've got WAY too much time on your hands, codsey.

So far as I know my insurance doesn't cover blind people taking a swan-dive from the second floor because they didn't take all due care to negotiate themselves safely to the loo.

And this would cost his 'friends' a sh*t-load for defaulting on their 'No Claim Bonus'.

so you are saying if your wife ran you down in the driveway and you ended up in a wheelchair for life you would suck it up... is that what you are saying because it sounds like it.....

default ... are you kidding me??????..

you have strange ideas of right and wrong...

home insurance has a personal accident  liability clauses usually for a sum included.... if it didnt no one would invite anyone to their home... Roll Eyes Roll Eyes

Are you sure? I thought it was building not contents. Isn't that why landlords risk being sued if a tenants visitor falls.
If they were covered by contents insurance, they'd sue the tenants insurer instead.

John, both have public liability provisions.

How do I know?

I renew all our insurance policies...and I look at the fine print, not just the annual premium amt.

whereas I just look at the amount and issue instructions to wifey dearest as to pay or bin .  Cheesy Cheesy Cheesy

Actually John, you're probably right. I am bossy.

I've had a lot of responsibility thrust on my shoulders ever since I was a kid and esp after my dad died.

I've had to make big decisions, keep family matters under control < --- there's that word again. Looking back, I don't know how I did it.

Mum put all 4 of us through uni, but the truth is I worked 3 jobs (1 full time and 2 part time) while I studied at uni part time, to keep us all going.

I bought my 1st house and 1st car during my 1st yr at uni. I was running around like a bloody machine and I honestly thought I was invincible. I just kept going...I had tenants to find to help me pay off a mortgage. I saved like hell. I learned to control my money though. And to this day, this experience has taught me that I can manage money very well. I triple check everything, I negotiate/haggle, compare 6 quotes before signing on the dotted line ie entering into a contract etc.

The only mistake I made re money? I didn't have a pre-nuptual agreement for my 1st marriage. Marriage no 2 would never have taken place had he not signed a pre-nuptual agreement. As it turned out, it was good for both of us given we were both divorced and had kids with our 1st spouses.

So...life's circumstances/experiences make you the person you are today. It's probably why I need to be with an older guy in my life....to help balance the "who's the boss" factor out.

Anyway....

Ah-HAH! I missed that.

That's the Defence Counsel's "Gotcha!" moment right there.

He's going to lose the case and be ordered to pay all court costs.

He'll be lucky if he doesn't end up having to sell his wheelchair.

I don't think he'll get a Christmas Card from his 'good friends' this year ... possibly a letter-bomb, but definitely not a Christmas Card.

I'll take your word for it. My insurance brochure Information Book is all small type and runs to WAY more pages than I can be bothered to slog through.

Just call them up and ask them.

I read a lot of fine print esp re insurance policies. That fine print is what makes a policy stand out for me.

Are you SURE that's correct?

When Bob Carr was premier of NSW he changed the law from Council liability for injuries sustained by tripping up on tilted pavements - (and the rest) - to this now being a matter of Personal Liability for injuries sustained as a result of carelessness.

He put a stop to the racket.
