Grendel, you are getting the whole 'innocent until proven guilty' thing backwards. You don't lock people up just in case. You find out the facts. This duty of care is even greater for crazy people, because they are less able to act in their own defence.

You have no grasp of reality or common sense do you...

Do try to read what went on before making more comments.

If immigration didn't intervene and they had to, she could have been arrested for vagrancy or some other minor charge requiring detention.

If she had been listed as a missing person by her loving family who are always sticking in their 2 cents worth - particularly the sister - this whole scenario wouldn't have happened.

Although DIMIA was in a mess at the time and there might have been some protocol overlooked.

There are an estimated 300,000 people here who have overstayed their visas - and this is a conservative figure.  Cornelia Rau could easily have been one of them.

Grendel, it is not her initial arrest that is the problem. That was based on reasonable suspicion. It is the ten months in custody that is the problem.

Well we know DIMIA is slow, but in this case I personally can't blame them considering the cirumstances.

And mantra makes an excellent point re the lack of a missing person report too.

In my opinion she should never have been compensated.  The circumstances of the situation was not normal and I think everyone except the people running Baxter did their best.

So what should have DIMIA done they didn't fd?

They should have figured out whether she was an Australian citizen.

Well what didn't they do to accomplish that fd?
Mind you DIMIA is more interested and geared towards identifying foreign overstayers etc.

Oh and BTW she wasn't an Australian citizen

She didnt have to be. She was a permanent resident.

When you lock someone up under our law, you better be damn sure you have the right to do so, whatever the reason...otherwise, get out your checkbook. Unlawful detention is pricey.

Wasn't my point in the first place...  just correcting fd.

They left an innocent person locked up for ten months without getting it sorted out. They cost the public millions of dollars. Grendel you seem to be having trouble comprehending that leaving someone to rot in jail is not a reasonable alternative to due process.

No I'm having trouble getting out of you what steps measures etc you think they should have taken that they didn't.

She wasn't left to rot at all.
Now you tell me what they did if you can since you seem to not know what they didn't do.

They didn't find out who she was or whether she had a right to be here.

Good grief...  and what should they have done fd...  stop pussy-footing around the questions for a change.

Frankly I'm sick of asking.

They police  asked her who she was...  she kept telling lies.
She was interviewed by immigration she kept telling lies.
The German consolate was brought in..  she lied.
Immigration checked here and O/S...  she lied.

Now what were they supposed to do in your opinion?
There is no Australia card.
There were no fingerprint records?
There is no global registar of people on the planet.
No global face recognition system or DNA bank.

So come on...  tell me what they should have done?

They should have found out who she was or whether she had a right to be here. It's their job to know how to do it, not mine. We can't just go locking up every crazy person who doesn't know what day it is. Simply asking a crazy person 'who are you' and getting an answer that is obviously a lie is not enough.
