South Australia's Attorney-General Michael Atkinson has ridden his bike, with an Australian flag displayed, to an Adelaide house where the Nazi flag has been on display.

Mr Atkinson spoke with a resident there about their action.

"There is a law against inciting racial hatred and it's conjectural whether this would fit this law," he said.

SA Premier Mike Rann has condemned displaying the Nazi flag in Australian society.

"Anyone who flies the Nazi flag, in my view, is un-Australian," he said.

"Anyone who flies the Nazi flag, in my view, doesn't deserve to have the protections that our diggers fought for.

"What kind of bonehead would fly the Nazi flag?"

Lawyer George Mancini chairs the Council for Civil Liberties and says it is hard to say whether a prosecution for flying the Nazi flag would succeed under racial vilification laws.

"I think it would technically in some respects suggest that we're restricting people's freedom to display a flag like that," he said.

"I think in our society we can tolerate that. We don't necessarily support it or agree with it."

A resident of the house at suburban Croydon says the flag was left on display after a drunken party. It has now been taken down.

What it comes down to is the individuals right to do as he wishes. He isn't "inciting racial hatred" by displaying a flag, if the law prosecutes him for this we truly are living in a police state.

It's a pity what the flag represents because the Nazi flag is a cool looking flag.

It does raise interesting points about tolerence, freedom of speech and whether it does actually, in itself insight hatred.

That's the oldest trick in the book - 'I was drunk, it's not my fault'.

I'm guessing he's a closet nazi whose mates outed him by hoisting his flag after he passed out.

Anyone taking bets on whether he's a One Nation supporter?

You know what I took out of this the most......

The facking Attorney-General rode his FACKING BICYCLE over there, had a bit of a chat, and they took the bloody flag down and apologised!!!

It was very much a different story the day before when the meeeedia were over there trying to goad an angry, tattooed, bird-flippin' bogan into doing something rash while he was taking out the rubbish.

Mr Attorney-General you are a champ.

If I had a flag it would be a flag of my kok and I would fly it on a flag pole at my house. That would be funny.

Absolutely!

This is going waaaay back into the age of innocence but some dude (uni student in Adelaide?) painted a big assed Nazi flag on his garage roller door. Same result. All the neighbours up in arms.

And I'm looking at the picture in the newspaper going "Why??? That is the coolest thing I have ever seen!"

That is superb!!!

Are you the same dude wot said golfers need absolute silence before a shot coz no other sport requires such concentration and suppression of adrenaline and you should know coz you’ve played a lot of sport?

Coz I’m thinkin’ you’ve never been on a bender. The amount of strange stuff in strange locations that has been left for days, sometimes months, back in my student days…

So I hooked a DT by mistake? I guess I'll have to release him.

If the Nazis were still in power in Germany, there would be a Nazi flag flying from the German embassy. Fortunately they are not, and the flag only represents the great evil they committed for a few years. However, I'm sure an old differ would be justifiably concerned if someone raised some other enemy flag in the backyard next door.
