What would be an appropriate punishment for this (if found guilty of course)?

An HIV-positive Melbourne man who allegedly infected two other men has failed in a bid to have his identity suppressed in his preliminary court hearing.

Michael John Neal, 48, of Coburg, faces 122 charges relating to sex with 16 men when he was knowingly infected with the HIV virus.

He appeared at the Melbourne Magistrates' Court on Monday for the beginning of his committal hearing where his lawyer David Sexton applied to suppress his client's identity.

He said publicity surrounding the case had jeopardised Neal's safety and health, and that he had been threatened and attacked in custody by other prisoners.

The 122 charges Neal faces include 14 of attempting to infect a person with a very serious disease, two of intentionally infecting a person with a very serious disease, rape, reckless conduct endangering serious injury and possession of child pornography.

I have no sympathy for what happened to his partners as the sex act amongst gay men leaves me shaking my head at its affrontation to my beleifs about the sex act in relation to procreation and its purpose fullstop.

If he was attacked by other prisoners..thats is not acceptable. He has a right to be safe in custody regardless.

There are human rights issues involved for the safety of his unsuspecting partners..




But I would imagine a gay man would have to be pretyy bloody stupid to not ask questions about his own sexual safety in this climate of AIDS etc.  They have a responsibility to themselves dont they?.........................................?



A silly arguement, and one Ive heard before..someone I knew had this happen to him.Its common in the gay community.Its called revenge.

The gay man who is the MOST dangerous is the closet gay..he is married AND having gay sex with other gays...infecting his wife and unborn children..this is the gay man who is the most dangerous and has the biggest disregard for human life.........

Well... personally I think it's no big deal that gays kill gays with aids.

If this gay guy decided to spread this disease to someone straight on the other hand...

i heard about this in the news yesterday, apparently after this guy became HIV positive he decided to have unprotected sex with other men so that it would increase the pool of people who are infected and also increase he selection of men to choose from.

i personally don't care, i hate gays anyway, i know that's not pc. i tend to refer to Rev Fred Nile who said it best "God created Adam & Eve, not Adam & Steve". besides, why would u go for other men, when there are beautiful woman around?

i don't get why this guy couldn't use a condom.

and it's stupid on the other guy's part as well, what kind of an idiot has unprotected sex with a total stranger? that's regardless of whether they are gay or straight.

Obviously gay men aren't physically attracted to females, although gay males usually like female company - so that leaves only one reason for their attraction to other males.  What have males got that females haven't?

Obviously it all comes down to "rooting" and I don't mean that in a crude sense, just something that is essential to the basic instinct of most males.  Shocked

I seem to rememeber hearing there were "parties" where men would knowingly try to get aids from someone infected, to "join the club" !!
Some "clubs" I don't want to join !!!

This is not meant to undermine males and I am only guessing - not being gay or male.  Some would say males are more sensitive than females so they turn to other men for emotional comfort.

Who knows - but this guy who is spreading Aids is evil.

If he's going to die - he wants others to as well.

If the spread of the disease was intentional, the same punishment for GBH (if the victim doesnt die) and murder (if they do).

There was an article in the weekend australian this morning claiming that these recent cases are due to bureaucratic ineptitude combined with crippling 'political correctness' that prevents them chasing down gay men who spread aids. The PC stuff stems from the 70's or 80's when they were worried about an over-reaction against the gay community. It also claimed there was a growing subculture within the gay community that deliberatley takes risks by riding bareback, and even some who go looking to catch aids ('bugchasing'). The bureaucrats working on the anti aids comapaign assume that awareness is all that is needed, like with the anti smoking campaign, but ignore these groups for whom it means nothing.

I read that article today.  It's very strange.  Some gay men obviously hate themselves to even contemplate the thought of catching Aids to become part of some sub culture and to belong.  They appeared to discuss it as though they were getting a tattoo.

The worst of it is - the bi sexual males who are married or in a heterosexual relationship and continue to sleep with other males.

An AIDS-afflicted homosexual man deliberately infected a younger sexual partner with the deadly HIV virus, a Brisbane court has been told.

Jamie Michael Richards, 34, of Highgate Hill in inner-city Brisbane, pleaded not guilty in the Brisbane District Court to intending to transmit a serious disease and unlawfully transmitting a serious disease due to sex with a 20-year-old man.

He faces an alternative charge of grievous bodily harm against the man, whom Richards allegedly had a casual sexual relationship with.

"There were a number of conversations about the use of condoms ... Jamie would say it was okay not to wear one because he'd never had a sexually transmitted disease," Mr Vasta told the court.

Mr Vasta told the court Richards had known he was HIV positive since 1995 and had been advised by help services not to expose others to the infection.

The court also heard Richards told police in 2003 that he had "full-blown AIDS and hepatitis C" while questioned over another matter.

Mr Vasta said Richards still denied he had AIDS in a telephone conversation with the victim taped by police.



HIV man ordered to stand trial over sex

A Victorian man accused of spreading HIV through unprotected sex has been ordered to stand trial.

Solomon Mwale, 38, of Grovedale, has pleaded not guilty in the Geelong Magistrates' Court to three counts of reckless conduct endangering serious injury.

Mwale met his alleged victim, who cannot be named, in a video store in November 2000.

The pair began a relationship which Mwale ended on Valentine's Day in 2004.

The alleged victim told the court she still loved Mwale despite contracting the disease.

"I will take my love for him to the grave, but I will never forgive what he has done," she told the court.

Yes I was shocked at this.  I think Victorian Health is partly to blame for being too soft on perpetrators for these sorts of crime - paedophiles included.

Just goes to show - don't trust anyone - don't have unprotected sex.  The warnings have been there for years.

But expect a wave of immigration in the next twelve months.  The figures are going to double according to the immigration department - although it was only shown in the media once.

The problem with this is that immigrants are only being randomly screened for diseases.  Doctors have been complaining about all these new fungii being seen on some immigrants - not to mention HIV and TB.  We have kept Australian relatively disease free for years and health checks used to be very strict.  Now with Howard and his cost cutting government - checks are only made on about a third of all immigrants.

We haven't got adequate health services in place to ensure that these immigrants are followed up and their diseases controlled.

You are confusing two separate issues. There may be a case for increased or mandatory testing, but not for stopping immigration.

We have kept Australian relatively disease free for years

What diseases? Polio and TB maybe, but not aids. The ones that are a real concern for us are the ones we already have.

My mistake - I should have said Polio & TB.  Yes aids is already on the increase in Australia and not enough attention is being given to this.

Polio & TB are not serious threats. The same things that have enabled us to virtually elimiante them will also stop them spreading, despite an occasional traveller bringing it in.

No ... you see.... they aren't separate issues, freediver. They're connected.

Africans = HIV
Africans = Migrating to Australia.

They are not separate issues at all. To get rid of one problem we must get rid of another.

You could argue that Africans can go to the United States... infect someone else... and that someone else comes to Australia... but that's unlikely... because Americans are decent minded enough to report HIV infection, who don't go around sleeping with everyone they can with little consideration or knowledge about then infetion.

The Geelong Government is saying that their testing is actually top-notch/strict at the minute... so I doubt whether they can get any more stricter than they actually are. -Which is quite worrying and my reasoning behind my response.

These African citizens are useless anyway. They've caused nothing but trouble since they've arrived. The only 'skills' they bring to this country are 'trolley pushers.' They're lazy... they're packed with aids... and they make people feel unsafe at night in my neighbourhood.

Risky gay sex is behind Australia's sharp surge in HIV infections, a national study of hospital data has confirmed.

And while NSW has escaped the resurgence, other states such as Victoria have been hit hard, according to the report in the Medical Journal of Australia.

The major survey of HIV rates found that 12,313 Australians were infected with the lifetime disease in the 13 years between 1993 and 2006.

The number of new infections dropped 30 per cent in the 1990s and then climbed back to the same high between 2000 and 2006.

Professor John Kaldor, deputy director at the National Centre in HIV Epidemiology and Clinical Research, said the rise was due mainly to risky sexual behaviour among gay men.

Virus exposure through male-to-male sex accounted for 70 per cent of all cases, followed by heterosexual contact at 18 per cent.

In more than half of heterosexually-acquired cases, the person was born in or had a partner from a country with a high prevalence of HIV.

Exposure to HIV from injecting drug use was relatively rare, Prof Kaldor said.

Prof Kaldor said there seemed to be a misunderstanding that HIV was no longer a serious disease.

"It's true treatments have improved a lot, but it's still very serious," he said.

"The treatments are still difficult and there are still several hundred Australians developing AIDS and dying every year."

The rise also raised questions about the effectiveness of current HIV prevention strategies, said Prof Kaldor, who called for new ways of promoting health messages to the gay community.



Ice fuelling HIV epidemic: research

Sex lubricant could stop HIV and herpes

Tests on lab animals have shown that the microbicide gel, called Viva Gel, inactivates the HIV virus and another responsible for genital herpes.

Circumcise now against HIV: expert

US scientist Professor Robert Bailey has warned delegates at the International AIDS Society conference in Sydney that widespread circumcision programs have been delayed too long already, and further stalling will endanger more lives.

About 4,000 men are infected with HIV every day in sub-Saharan Africa, including 3,000 who are uncircumcised.

Rates are highest in countries like Botswana, where circumcision is rare.

Three major African studies recently confirmed what researchers suspected as far back as 1995 - that circumcision cuts the risk of HIV transmission by up to 60 per cent in heterosexual men.

The practice does not appear to benefit gay men in the same way, making it of little use for Australia's at-risk group.



Post-sex washing 'doesn't lower HIV'

The study of uncircumcised Ugandan men presented at an AIDS conference in Sydney found that so-called "penile cleansing" with soap and water does not reduce the chance of contracting HIV infection.

The result was disappointing for the research team who had hoped the popular practice could be a cheap and effective alternative to circumcision, which was recently proven to offer 60 per cent protection for heterosexual men.

THE Federal Government will consider barring the entry of migrants or refugees with HIV, raising questions about the absence of HIV screening tests for more than 200,000 temporary workers and others who arrive each year.

Responding to claims by the Victorian Health Minister, Bronwyn Pike, that 70 new notifications of HIV-positive people were due to "immigrants" to the state, Mr Howard said he thought Australia should have the most stringent possible conditions in relation to HIV migrants, though humanitarian considerations could temper that in certain cases.

The Immigration Department said it had allowed 64 migrants with HIV to stay after waiving requirements that bar those whose illness may generate significant health costs.

The executive director of the Australian Federation of AIDS Organisations, Don Baxter, said there was minimal evidence that HIV-positive migrants posed a risk of spreading the disease.

"If it is happening, we would know about it because we have the best HIV screening in the world," Mr Baxter said. Any suggestion that temporary visa holders should be screened was a "red herring" because cost, logistical problems and the lack of evidence that it was needed made such an extension unlikely.

He said Ms Pike's suggestion that health checks on migrants were not rigorous enough was an "appalling" attempt to divert attention from Victoria's poor record on containing the HIV rate.

Lawyers at the HIV/AIDS Legal Centre in Sydney, David Puls and Kathryn Viegas, said the law allowed for migrants to be denied access where there were public safety concerns, but the Commonwealth medical officer did not consider HIV such a concern.

Bad idea, that's all I have to say. I think people need to look deep within themselves if they agree with this policy on any level...

Funny though that only a few months ago Pauline Hanson said exactly this... I feel like its 1999 all over again...

Why is it such a bad idea? Immigrants have to satisfy other criteria such as having the skills we need. And Howard has left the door open for not barring 'humanitarian' immigrants. But even they should still be tested, especially if they come from an area where AIDS is rife. Letting someone with a high risk of aids immigrate and not even informing them of whether thay have the disease is a bad idea.

According to the available stats, most HIV+ immigrants come from first world countries, not third world ones.  Further, it appears that as HIV+ is a treatable disease and we already have HIV+ citizens, the addition of the very small numbers that we are discussing here, would not place any more burden on our medical services.   HIV+ is not the most deadly disease out there.  Personally, I'm much more worried by bird-flu, SARS, even Ebola and Marburg and even plain out TB (particularly from the fUSSR where antibotic strains have been identified) than I am by HIV/AIDS.

It's not so much that they'll spread HIV (even though it could happen) - it's the fact that our hospital system can't even cope with us.  Where's the state government going to get the extra money to treat all these people - they won't be able to work?

Otherwise it wouldn't worry me - unless they deliberately tried to infect others.

Do try and keep up people.Australia already has a policy in place about people with spreadable deseases and aids in particular.Also age and ability to live without support comes into it as well.Google Govt Policy Immigration.
Howard is just making political points and retaining focus on his party.

"In the highest prevalence areas, the impact of circumcision would be greatest, and the intervention would be highly cost-effective," said Bailey of the School of Public Health at the University of Illinois.

Estimates from studies show millions of new HIV infections could be averted in sub-Saharan Africa if substantial proportions of men were circumcised. Studies suggest that widespread male circumcision in sub-Saharan Africa could prevent 5.7 million new cases of the disease and 3 million deaths over 20 years.

Bailey, who has devoted most of his research activities on the issue of male circumcision as a possible HIV prevention strategy since 1995, said uncircumcised men were two-and-a-half times more likely to contract the virus from female partners, based on random control trials conducted in parts of Africa, hardest hit by the epidemic.

"There is mounting evidence of its efficacy in preventing new HIV infections. One cannot help but contemplate that if it were a drug or a compound or a shot with a label, international agencies and donors would have been fighting to be the first to make it available many months, even years, ago," says Bailey, who has conducted circumcision-related studies in varying communities in Uganda, Kenya, Malawi, Zambia, as well as in the U.S.

He said the incidents of the disease among heterosexual men could be reduced by up to 9 percent over 10 years, if 50 percent of the men were circumcised in parts of South Africa. "In other words, circumcision could drive the epidemic to a declining state toward extinction, ''Bailey said.

He urged local governments to "make safe, affordable, voluntary circumcision available now." He said younger men would like to get circumcised, but ‘’the service is not widely available and there is no funding.’’

Male circumcision is probably the oldest surgical procedure, dating back to at least 2300 BC in Egypt. Today, about 30 percent of men in the world are circumcised, with about 67 percent of them in Africa.

Circumcision is not just a health-related intervention, it is tied to a complex web of cultural and religious beliefs and practices. Bailey said, ''Studies have shown that women are in favour of circumcision because of improved hygiene. As circumcision becomes more widely accepted through impetus by women, the age of males when they are circumcised will decline. Mothers are going to be major drivers in pushing infant circumcision.’’

In a statement issued in February 2007, the World Health Organisation (WHO) and the UNAIDS Secretariat welcomed the detailed findings of two trials undertaken in Kenya and Uganda to determine whether male circumcision has a protective effect against acquiring HIV infection.

The findings of the two trials supported the results of the South Africa Orange Farm Intervention Trial. Together the three studies, which enrolled more than 10,000 participants, provide compelling evidence of a 50 to 60 percent reduction in heterosexual HIV transmission to men.

"These findings are a very important contribution to HIV prevention science. Male circumcision has major potential for the prevention of HIV infection", Kevin De Cock, director of the WHO HIV/AIDS department had said in the statement.

However, the WHO warns that male circumcision does not offer complete protection against HIV. Men should still use condoms, adhere to abstinence, reduce the number of sexual partners and delay the start of sexual activity.

Organisers of the IAS 2007 are calling for greater vigilance to ensure universal access to HIV prevention and treatment, and prolonged research to inform and strengthen the global response to HIV.

IAS president and the conference co-chair Dr Pedro Cahn said, "With fewer than one-third of people living with HIV in low- and middle-income countries having access to life-saving medications, and still fewer with access to proven prevention services, such as condoms and sterile syringes, the goal of universal access by 2010 must remain a priority.’’

"Science has given us the tools to prevent and treat HIV effectively. The fact that we have not yet translated this science into practice is a shameful failure,’’ added Cahn, who is the Director of Fundación Huesped in Argentina.

Emphasising that "good research drives good policy and programming," the IAS and Australasian Society for HIV Medicine (ASHM) last week issued the Sydney Declaration, a global sign-on letter that urges governments and donors to allocate 10 percent of all resources dedicated to HIV programming for research.

The dreaded combination of social engineers and lawyers will be the downfall of society. It is now looked upon as a cruel and unnecessary surgery.

Perhaps the decisions of our forefathers and ancestors should be more carefully considered before the above two professions get their grubby little hands all over it.

What do you think of the idea of punishing people who unknowingly spread an STD? This was suggested in another forum. My initial response:

I guess if you have unprotected sex with a few different people over a short period without getting yourself checked out, maybe you should get done for reckless endangerment. However then you would have to charge people who screw around, regardless of whether they actually spread anything. The privacy implications are pretty nasty, and it would probably be unworkable, and a witch hunt.

Plus, if the person spreading it is unaware they have it, then you could argue that the person who catches it is just as much responsible for the spread of the disease.

I suspect the only practical approach is to educate people to look after themselves.

Also, a 'no fault' style investigation may work better than charging people. Most people will want to chase the disease down to everyone who might have caught it, but are more likely to clam up if there is a legal risk for them.

Maybe they should be able to issue orders forcing people to get themselves tested if a carrier has pointed the finger at them as another potential carrier.

Can be unlocked only after both willing parties have been thoroughly tested and signed the relevant legal forms.
Should they split up, they notify the authorities who reinstalll the chastity belts.


On a sensible note.
If they are unaware they have a STD it is immaterial. Ignorance is no excuse under the law.

I reckon GBH or manslaughter, depending on what STD it is.

CHILDREN under 14 are being infected with sexually transmitted diseases at a rate of more than one child a week in Western Australia, yet only six people have been charged with related offences in the past 18 months.

While attention focused on abuse in remote Aboriginal communities, it was revealed that one in three of the children infected with chlamydia, gonorrhoea or syphilis in the state lives in the metropolitan area, where no arrests were made.

The state Opposition yesterday called for the Privacy Act to be amended in a radical bid to catch more offenders by allowing police to access the medical records of suspects to see if they had the same diseases as the children.

An expert witness in the appeal of a HIV-positive man convicted of having unprotected sex with three women has been accused of misleading an Adelaide court.

One woman has since contracted the virus.

Perth medical researcher Eleni Papadopulos-Eleopulos has told the South Australian Supreme Court of Appeal that HIV does not exist.

Ms Papadopulos-Eleopulos is a medical engineer with the Royal Perth Hospital and heads the Perth Group, which believes that there is no link between HIV and AIDS.

An HIV-positive man, behind bars for having unprotected sex with three Adelaide women, has lost a second appeal against his conviction.

The full court of the South Australian Court of Criminal Appeal has ruled against Chad Parenzee's latest bid to have his case reconsidered.

Defence counsel had argued that a single appeal judge had failed to take into account the different streams of scientific thought about the cause of AIDS.

That judge rejected the defence argument that HIV did not exist and could not be sexually transmitted.



HIV sex worker may have infected 250

The ACT health system is desperately trying to contact 250 people who may have been infected with the potentially deadly AIDS virus by a male sex worker.

Hector Scott, 41, of Kingston appeared in the ACT Magistrates Court earlier this month charged with knowingly infecting someone with a sexually-transmitted disease and failing to register as a sex worker.

At the time, the specifics of the disease were not known.

"Bear in mind please 250 is just the number of phone numbers and he may have been phoning family friends, businesses - there are all sorts of other reasons.

"That may be a very inflated figure of the number of people that he had sex with or unprotected sex with."

Dr Guest would not say how the contacts were obtained and said many of the phone numbers being used were mobiles so it was unclear whether all of the potential victims were from the ACT.

"We will be exploring that nature of their contact very delicately with them - we have skilled counsellors and clinicians involved in this process," he said.

The health department first became aware of Scott's actions on December 20 last year when notified by another jurisdiction. The department alerted police within 24 hours.

But Scott was not issued with a public health order - to stop working as a prostitute - until January 4, when he was arrested.

Dr Guest said there was evidence Scott had been HIV positive for some years, possibly since 1999.

During 2007 he advertised himself as a prostitute in Canberra media using the names "Adam" and "Josh" but was unregistered as a sex worker.

Dr Guest said the whole situation was just a reminder of the importance of safe sex.

Anyone who believes they have been in contact with Scott is urged to contact their general practitioner, the Canberra Sexual Health Centre or call ACT Health on 1800 000 974.



HIV-positive prostitute pleads guilty

An HIV-positive male prostitute has admitted to potentially spreading the deadly virus in Canberra.

Hector Scott, 41, from the Canberra suburb of Kingston, pleaded guilty in the ACT Magistrates Court to providing a commercial sexual service while knowing he was infected with a sexually-transmitted disease (STD) and failing to register as a sex worker.

An alert was issued in New Zealand after Scott flew there at Christmas, but New Zealand health authorities said this week no one had reported any contact with him there.

Well its a bit late.
There's already been an African immigrant who purposely went out and infected 117 Australian women with HIV.
Of course, after which he was caught and charged.
Now there has been, in the last 5 years - another 32 cases of African men purposely infecting both women and men of Australia with HIV.
Still not as bad as African Witch Doctors  telling HIV'ers to go out and rape infants (whiter, the better) as a cure for their disease.
But still bad enough.

Wonder how many Sudanese in Melbourne are HIV?

Well its a bit late.
There's already been an African immigrant who purposely went out and infected 117 Australian women with HIV.
Of course, after which he was caught and charged.
Now there has been, in the last 5 years - another 32 cases of African men purposely infecting both women and men of Australia with HIV.
Still not as bad as African Witch Doctors  telling HIV'ers to go out and rape infants (whiter, the better) as a cure for their disease.
But still bad enough.

Wonder how many Sudanese in Melbourne are HIV?



I wonder what sane Aussie woman would go near one of those men without having him first tested. Brain dead if you ask me.

Obviously gay men aren't physically attracted to females, although gay males usually like female company - so that leaves only one reason for their attraction to other males.  What have males got that females haven't?

My mate is dead from HIV.
But he was a tall good-looking Angel blonde who lived in Thailand for 15 years, worked for the King and shagged 'thousands' of Thai women who found his 'Angelic' looks more masculine than any black dude could harden up to.
But it took 15 years for him to catch HIV. He had fathered about 42 kids to 42 Thai women.

Upon his return to Oz (where he eventually died). He told me it was hard to get a root here - because only 17% of HIV sufferers were Female. Only 5% of HIV males were 'Heteros'. The rest were all bum-pumpers.
