Labor will refund an illegal $200,000 donation that was used to fund polling in Kevin Rudd's seat during last year's federal election, according to a report.

The donation was allegedly paid to Labor's Griffith branch bank account by Taiwan developer and former banker Kung Chin Yuan on September 3, The Australian reports.

Labor officials found the transaction during an audit and were advised by lawyers that it breached state electoral laws.

It is illegal in Queensland for a registered political party to receive a gift of foreign property.

Labor's administrative committee called late Wednesday for party pollster UMR to return the money so it can refund Mr Yuan, who has lived in Australia for 20 years.

Mr Rudd has steadfastly denied any role in arranging the donation.

"As for Mr Rudd as a candidate, all campaign disclosure responsibilities have been complied with and any suggestion to the contrary is untrue," Mr Rudd's spokesperson told The Australian.

"All matters concerning the disclosure of campaign donations are the responsibility of the federal and state ALP offices and all queries should be directed to those parties."

Comment has been sought from the Labor party.

Labor has form in this area. Labor donated $10 million of taxpayers' money to trade unions to "train upcoming union leaders" in its 2011-12 budget. This followed Kevin Rudd's $10 million donation in the 2010-11 budget. Unions have now been fully compensated for their $20 million donation to Labor at the 2007 election. Imagine the furore from the Left if Abbott had compensated Rupert Murdoch for his campaign contribution using taxpayers' money!!!

Look I am going to go out there on a limb, but, do you get it that if they had not done the audit, it would not have been discovered for some time if at all. Do you get it that an audit is a part of being transparent.

Sheesh, in a perfect world it would not have happened in the first place, but then again, in a perfect world there would be no need for audits, because it would not have happened in the first place, ergo, no need to check or review.

Remember, breath and keep both eyes open.

Actually, I personally find it quite concerning that we do not hear more of these issues from both sides of politics. That is what I think should bother you...
