This guy really hits the nail on the head and is spot on in his assessment of Trumps tactics in Court. He’s also right about why Trump has stacked the justice system with loyalists - he would be decimated in a free and fair system where the people who sit on those Courts owe him nothing. I really wish he had lost the election if only to have seen Jack Smith take him to the cleaners in Court, because Trump absolutely deserves to die in prison of old age for his many crimes.

The writing was on the wall as early as last week, after the Supreme Court said it wouldn’t consider Trump’s effort to overturn the 2023 verdict. But Trump made a series of eleventh-hour attempts to forestall the payment.
First, Trump asked U.S. District Judge Lewis Kaplan to reject Carroll’s request for payment so that he could ask the Supreme Court, which had already declined to get involved, to reconsider. Then, when Kaplan instead granted Carroll’s request, Trump appealed that ruling to the 2nd Circuit, asking the appellate court to pause Kaplan’s order. It also refused. The $5 million judgment resulted from a trial in which a jury found Trump liable for sexual abuse and defamation.Carroll alleged that Trump raped her in a Bergdorf Goodman dressing room in the 1990s and then described her allegations as a “hoax” after she went public with them during the first term of his presidency. A second judgment of $83.3 million came after another trial in early 2024, in which a jury awarded Carroll for another set of remarks about her claims that a judge had found defamatory. It’s getting surreal now, how far Trump and his lawyers will go to avoid him paying and taking responsibility for his actions. His lawyers went back to the original Judge and said Trump can’t pay Carroll because the Supreme Court hasn’t ruled. They just committed perjury because the Supreme Court did rule!

Trump lost in every single case in front of Judges appointed by both Democrat and Republican Presidents. But since we have seen Trump win a second term (funny how the election isn’t rigged if he wins), we’ve seen this administration ignore literally hundreds of orders from Judges appointed by Presidents from both parties. But only the Supreme Court, which Trump stacked with right-wingers with the help of Lindsay Graham, has more often than not ruled in his favour to erode rights for ordinary Americans, starting with Roe v Wade. Don’t forget that it was Graham who refused to confirm a nominee of Barack Obama for the Supreme Court nearly a year before the next election but had no problem doing the same for Trump just 8 days before a Presidential election. The hypocrisy is blatantly evident. |

The politicisation of the courts is a bipartisan phenomenon. When politics is more polarised, so are the courts whose judges are either political appointments (supreme court) or are elected along political party line (state courts). With more politicisation comes more judicial activism (ie invrntung rights, intentions, interpretatilns etc). Roe v Wade was such a judicial creative intervention, creating and inventing a right and thereby a law that was not there before. But it is not for courds to create laws so the overturning of RvW was a simple return of legislative powers to state legislatures. As for litigating the 2020 election - that's a big topic. Most cases turned on judges declining to examine the claims. It is also significant that many states reviewed and strengthened their electoral rules after 2020 indicatjng yhat there was room for chicanery. In any case, election rigging has a very long and colourful history in the US. One significant way the elections are rigged is by media bias. There are many and glaring examples of this but perhaps the most spectacular one in recent times was Trump's 2016 victory after months of being written off by most mainsream tv and newspapers. |
