The "Doli Incapax" Principle says that for children aged 12 to 13, the legal principle of doli incapax applies. Under this common law rule, a child is presumed to be legally incapable of committing a crime. For a child in this age group to be charged, the prosecution must prove beyond a reasonable doubt that the child understood their actions were seriously wrong at the time the offence occurred.

This is ridiculous. Even my 8 year-old son knows right from wrong. To say that a child aged 12-13 doesn't understand their actions are seriously wrong is an insult to the intelligence of every law abiding citizen. Time for this loophole to be closed and the age lowered to 10 years old. Time also to vote out this incompetent Labor government this November.

I was going to respond "Are you drunk, Grappler?" until I saw the smiley faces move across the message.

If I can get accused of a crime at 9 years old, I am sure 12 and 13 year olds can face criminal prosecution.

Might want to take up an issue with the victim's mother, Denise. It is difficult to accept that Denise almost lost her son to a kidnapping the day before at a commercial shops. And then for her to lose her son the next day at the shopping centre, it reeks of neglectful motherhood on Denise's part. The 'woman' takes every opportunity to write a social media post to defend any implied involvement in the killing. And her interviews show her to look like a guilty woman. Staring at the camera for 10 seconds, as if she was getting her mugshot taken, before redirecting her focus back to the interviewer. The amount of times Denise has the body language of someone guilty, darting her eyes around everytime she lies.

I think the only other people I have seen do that was Cleo Smith's mother and stepfather, doing everything to hint that they were involved.

You're looking for Justice in any state of Australia - or is it justice you are seeking...  you'll have no difficulty finding Justice - any 'magistrate' shoe-horned into the job can hand that out to you guilty or not - but you may find justice as hard to find as Ned Kelly did.

Where we lived - over the range from Kelly Country, and with a neighbour a rellie of the Kellys (me aunt was a Kelly but not that sort) - Ned is commonly regarded as a revolutionary and not a criminal as such.  You have to be a careful politician to be elected down that way...

Well - you know that heat waves, cold snaps, tidal rises, earthquakes, wars, economic issues and all such affect women, Blacks and ethnics more than White Men... that's a given... and we all know that changes to social security or law or anything remotely like that will impact on those same groups more than on White Men.. ergo - making younger kids legally responsible for deep crime will impact on women, ethnics and Blacks more... easy.. think of the dire outcome if they dropped the Pussy Pass... and said that 14 stone woman was never lead by that nine stone skinny jockey look-alike bloke to sexually assault etc all them girls in WA... think how many more women would go down for DV...

If parents haven't got it through to their kids at nine that murder is not acceptable - something is wrong about those 'parents' and they need to be stood in the dock as well.

"You are hereby charged with murder by depraved indifference, in that on or about 2017 and 2026 you failed singularly to introduce into your children's minds the simple reality that they should not kill other children.... how do you plead?"

"Not guilty by virtue of mental insufficiency,!"

"You mean too stupid?  What is your IQ?"

"I dunno - they said I 'ad a Low Q... No IQ to speak of.. the mentioned cooler room temperatures..."
