Title: Democrats to free Maduro Post by Leroy on Jan 12th, 2026 at 8:14am
Democrats are calling the military capture of Maduro illegal. If his capture was illegal then the courts cannot charge him, in American law for the prosecutor to bring charges they have to have clean hands, the court cannot accept an unlawful capture. The only option available to the demo is to return Maduro to Venezuela.

It is illegal. It is blatantly illegal because Trump is required as per the Constitution to seek approval from Congress before carrying out a raid like that and taking into custody a foreign leader - legitimate or not. So yeah, it is very illegal. |

And yet, they captured David Hicks at Afghanistan airport, declared him a terrorist and jailed him, before Australia received him. He was jailed here for 9 months, illegally and Alexander Downer said the man 'was a fool'.
(Fools get 9 months, or years if they can't appeal to the UN). |

Hicks was a fool, and a terrorist who trained with the worst terrorists. He deserved every second he spent in prison. |

I can't find where in the constitution it says that it is illegal, could you provide the part of the constitution that makes it illegal. |

Maduro is called 'narco terrorist' and had a torture jail.
Hicks was a visitor and was exiting from Afghanistan with no evidence against him. .(Under the US law in Afghanistan !!!) |

David Hicks was labelled an "unlawful enemy combatant" not terrorist.

Which makes it less legal as it means he wasn't in the army. Nor was he hostile to the US 'enemy' at the airport and wasn't 'combatant'.
'Julian Moti. The High Court of Australia ruled in 2011 that the prosecution was an abuse of process because of Australian officials' illegal deportation of Moti from the Solomon Islands, effectively ending the prosecution against him.' |

Article I, Section 8, Clause 11: The Congress shall have Power to declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water. The War Powers Resolution requires the president to notify Congress within 48 hours of committing armed forces to military action and forbids armed forces from remaining for more than 60 days, with a further 30-day withdrawal period, without congressional authorization for use of military force (AUMF) or a declaration of war by the United States. The resolution was passed by two-thirds each of the House and Senate, overriding the veto of President Richard Nixon. Given this, it's clear that Trump has broken US law. |

The highlighted bit would seem to cover the situation adequately. No illegality here. |
