Firearms Act 2024—Referral to Standing Committee on Legislation.

Apparently this has passes the Upper House and the Act will now come under the public scrutiny that it should have had before it became law.

Yes on the back of doctors saying they wouldn't do the mental health assessments.

Is there something wrong with the Legislation....Nothing to see here...No links....No credability....What is the problem???

Firearms Act 2024—Referral to Standing Committee on Legislation

Notice of motion

Hon Nick Goiran gave notice that at the next sitting of the house he would move:

(1) That the Standing Committee on Legislation is directed to inquire into and report on the Firearms Act 2024, which received royal assent on 27 June 2024, including any provisions that have not yet come into operation.

(2) Without limiting the scope of the committee's inquiry, the committee is to:

(a) particularly focus its consideration on those provisions of the act that were passed by the Legislative Council after time for consideration of the originating bill in Committee of the Whole had lapsed pursuant to standing order 125A;

(b) review the operation, effectiveness and implementation of those parts of the act, including any subsidiary legislation, that have come into operation at the time that the inquiry is commenced; and

(c) report on:

(i) whether any provisions have been implemented in practice by the government or any agency prior to such provisions having legal force and effect;

(ii) whether all provisions are consistent with fundamental legislative principles;

(iii) how the act may be amended so that every person convicted of a serious offence outside of Western Australia is subject to the same disqualification to hold a firearm licence as those who commit offences in our state; and

(iv) any other relevant matter.

(3) The committee is to report within three months.’’

One of the problems is the doctors not being willing to do the tests. Because any comeback could be on them, if it goes awry. They have to put pen to paper, they have to sign. Although the Government at present states they will not chase the doctors, that can always change at the stroke of a pen. ::)

Sounds like some doctors do not want to be held responsible if some gun nut goes on a rampage....The Legislation will be reviewed and mental health assessments will still occur....It may just become more specialized and difficult....Good news!!!

As I have said before a mental health check is only good as the time in which is taken. Stressors are not time-sensitive, they can occur well after the assessment. ;)

I suggest that they make the legislation enforceable. Although that is probably not obtainable.

So 7 out of the 52 were in one incident. The 52 were shot by the 90,000 gun owners, as at 2024, although numbers have been dropping. Some were multiple murders as noted. So 52/90000=0.06%. And 36 were killed by non-gun owners. 3 times gun owner's numbers. Illegal firearms? No murder is good. But the legislation has to be shown to be effective.

The Military can determine if you are a good shot and let you go crazy....A doctor can determine your mental capacity to posses a firearm....Many people are banned already because of their criminal record....As long as you have a reason and you are mentaly fit to own a firearm there is the inconvienience of visiting a doctor....Not having checks would be irresponsible....Owning a gun in Australia is a priveledge not a right....The Legislation is not going away it is being reviewed to address the concerns of certain doctors!!!

The scooters were banned in Melbourne in mid 2024 because of safety concerns.
