James Ashby says One Nation will not remove satirical video
of Robert Irwin despite legal threat

Pauline Hanson is ignoring a legal threat to remove a One Nation cartoon featuring Robert Irwin which the celebrity figure claims is defamatory.

One Nation published a two-minute video on Friday called 'The State of Queensland' which used Robert Irwin and popular children's character Bluey to mock the state government over perceived failings ahead of the election in October.

Mr Irwin has threatened to sue for defamation over the clip, which One Nation described as "tongue-in-cheek" and features Irwin's misadventures with Bluey through Queensland.

In the video, their car is stolen by "juvenile delinquents" before Bluey falls into a giant pothole on the Bruce Highway.

"Oh no!" Mr Irwin's character exclaims.

"Lucky the state of Queensland's got a world-class medical system."

Another character then laments there's a six-month wait for treatment.
'Unauthorised and deceptive'

Mr Irwin and Bluey have featured prominently in a recent Queensland government tourism campaign to lure visitors to the state.

The legal letter from Sunshine Coast lawyer Zoe Naylor accused the video's producers of "unauthorised and deceptive use of our client's image".

"We demand that you remove this video," the letter states.

It's satire.  Robert Irwin shouldn't take himself so seriously ... especially when Albo is the usual topic in those videos.

I wonder how he reacted to the scammed photo of him being "arrested" by police?  Now that would have been a legitimate grievance.

Anyone and everyone in public life has to learn to deal with these things.

Comedians do it all of the time you dickhead espcecially being a cartoon.

The question that needs to be asked is how much tax payers dollars did this Irwin character get for his propaganda ??

Another video making a comment:

Robert Irwin threatens to sue One Nation leader Pauline Hanson for defamation.

The conservationist claims he was mocked in the latest episode of Hanson's 'Please Explain' cartoon series.

Mr Irwin's lawyers have demanded the animation studio remove the video immediately.

Seems the Lawyer did refer to passing off  which is a fertile ground.  Defamation is not.

“You are potentially liable to our client in respect of defamation, deceptive use of a person’s image, passing off and misleading and deceptive conduct. We will commence legal action against you if you do not take down the video immediately.”

https://en.wikipedia.org/wiki/Passing_off

Passing off is a common law tort which can be used to enforce unregistered trade mark rights. The tort of passing off protects the goodwill of a trader from misrepresentation.

The law of passing off prevents one trader from misrepresenting goods or services as being the goods and services of another, and also prevents a trader from holding out his or her goods or services as having some association or connection with another when this is not true.

Irwin is a sad little soft cock whose only claim to fame is having a father who was a Darwin Award candidate. In any case the cartoon is true so it can't be defamation.

He went in too hard, but it's understandable why.

Anything that creates the illusion that he's associated with, and supports, Pauline Hanson and her party of attention-whore lunatics is a major cause for concern.

He probably should have first approached Hanson through their respective media teams, rather than go straight to the lawyers.

Anyway, fingers crossed that this ends badly for the brain-dead red-headed witch.

Evil POS that she is.

Pauline is a buggerwit, used by smarter people who get on her gravy train.  There have been quite a few, like...David Ettridge, David Oldfield, John Pasquarelli, Steve Dickson and the Slipper love match, James Ashby.  It will be Ashby behind the initial use of Irwin and the current handling of it.  Ashby is not dumb.  He is capable of having planned this from goah to Irwin's outburst, and of course it was the reaction which gave something I would have known nothing about, significant media coverage, and Hanson is coming out smelling like roses.  Irwin, whose brand has been passed off, is being made to look precious and petulant for doing doing other than protecting that brand which (and I hate saying it) is worth dollars.

As soon as he got the letter from Irwin's Lawyer, Ashby's eyes would have lit up and he would have been straight onto the phone to the Media.

I wonder what the Bluey creator/ABC have done?

Voila.  QED.  Short term win to One Nation, Hanson and Ashby.

If Robert just let it slide, he would have had a lot of support from the Australian public. But, to threaten to sue the producers of that short cartoon, Robert will be labelled a whinger. He should have laughed it off and, at worst, mentioned that he should have been asked if the producers could use him in a parody.

rubbish

It is not rubbish at all. The prevailing thought in the media is that Robert is a whinger who cannot handle a little heckling.

It's not about heckling.

It's about associating his brand - a well known, family friendly brand - with a far-right, extremist political party.

Kind of weird that they mention rental in Rockhampton. People are buying houses at reasonable prices around town here. Rental is low because there is not a great demand for housing, like there was 15 years ago.

Public Statement.
I, Bluey Heeler, am not and never was, a member of P Hanson Party. Robert Irwin has no financial or executive privilege over me, the ABC or the Bluey pups. I vote Animal Rights or what's left of them. Being a cartoon is no joke.

Stepmates Studios’ Mark Nicholson says the Pauline Hanson ‘Please Explain’ cartoons
have people “questioning” whether things they talk about in the cartoon “were real”.
“It’s been awesome,” Mr Nicholson told Sky News Australia host Chris Kenny.
“People are actually … questioning whether the things that we talk about in the cartoon were real.
“There’s some real problems in Queensland, and that’s what people are hammering.”

Note: In case you do not know.....young witless Irwin is suing Pauline Hanson
for including him in her "please explain" cartoon.
Shame he has NO sense of humour...

Quote:
Before the election campaign, Pauline Pantsdown was Simon Hunt, a lecturer in sound and film at the College of Fine Arts in Sydney. He was so affronted by Mrs Hanson's attacks on Asian immigration and welfare spending on Aborigines that he decided to take her on.

His technique was satire, his ammunition Mrs Hanson's own words. Using her statements and some literary licence, he created a song called "I'm a Backdoor Man". It quickly became the most requested song on JJJ, the youth network of the Australian Broadcasting Corporation (ABC).

Mrs Hanson, leader of the One Nation party, did not like it. She took out an injunction to stop the ABC playing it. Yesterday the Supreme Court in Brisbane dismissed the ABC's appeal.

Quote:
On X, Hanson doubled down on her position regarding the video, saying she would not take it down.

“I will not be removing the latest episode of Pauline Hanson’s Please Explain,” she said.

“I look forward to the day when Robert and I can have a good laugh over this and turn our focus to making Queensland a better state.”

Despite Hanson telling Irwin to “lighten up”, during the 1990s the One Nation senator famously took legal action to stop Triple J playing a satirical song about her created by the drag character Pauline Pantsdown.

The award, plus full indemnity costs, would pay for my VB requirements until I die, but I'll bet you have zero capacity to meet the judgement.

No one's buying. She should just pass off.

FD has always had the belief that I am not a retired Lawyer, still a Lawyer, so he is being consistent in that claim.

I hope he sues me for passing off as being a Lawyer.

He won't because he is full of it, and lacks the capacity to cough up when the time comes and he is shown to be what a flawed judgemental cock head he is.

Absolutely!  I'd love it if FD was paying for the VB until I die.

Why don't you ask him whether he will sue me?  You could even start a Poll about it.  I'll vote in that one.

So no-one is passing off. Aussie isn't because he gets no benefit for his professional advice. He gets a benefit by proving he's not passing off. Pauline, Robert and Bluey get nothing for passing off. Aussie drinks VB and gets passed.

'One Nation published a two-minute video on Friday called 'The State of Queensland' which used Robert Irwin and popular children's character Bluey to mock the state government over perceived failings ahead of the election in October.

Mr Irwin has threatened to sue for defamation over the clip, which One Nation described as "tongue-in-cheek" and features Irwin's misadventures with Bluey through Queensland.'

That's the opposite of your comment. Go easy on the booze.

Keep showing your stupidity fd. Everytime the law is mentioned you show how utterly clueless you are
You had no idea that as a dog owner you have a legal responsibility to secure your dog.
You had no idea that any fruit hanging over your fence line free for all.
And now it seems you have no idea that one cannot pass themselves off as someone else.

Stay stupid  :D

impersonate
verb
pretend to be (another person) for entertainment or fraud.
"it's a very serious offence to impersonate a police officer."

Was Pauline pretending to be Robert? Was Bluey pretending to be Pauline?  Who pretends the Bruce Highway has pot-holes?

We do all understand that little Irwin's comments came from his manager?

His simply creating news about himself as tbf, that's his job.

Obviously he was never going to sue .  The plan is to feed gossip sites with the story and pictures of himself for at least three months.

Again, as he should as that is his job.

Little Bob's manager is happy, what ever tv station his on is happy, the family business is happy, Pauline is happy the Qld tourism board would be delighted.

This little outrage has generated more publicly than the actual ads!

This is how the media and entertainment personalities can afford very nice things

Already answered this the first time you asked and for some reason you keep asking.  Are you thick?

You said I am the only one who claimed it is illegal to impersonate people. I did not claim this. You did. Hence the quote.

Do you think that comedians impersonating famous people are criminals?

We do all understand that little Irwin's comments came from his manager?

His simply creating news about himself as tbf, that's his job.

Obviously he was never going to sue .  The plan is to feed gossip sites with the story and pictures of himself for at least three months.

Again, as he should as that is his job.

Little Bob's manager is happy, what ever tv station his on is happy, the family business is happy, Pauline is happy the Qld tourism board would be delighted.

This little outrage has generated more publicly than the actual ads!

This is how the media and entertainment personalities can afford very nice things

All of it negative for Irwin/Australia Zoo, and all positive for Hanson, Ashby and One Nation.

Irwin did not take this to the Media, Ashby did as PHONs spin doctor and a PHON endorsed candidate in the coming Qld election.

"Despite threatening legal action over his depiction in Pauline Hanson’s Please Explain cartoon series, Robert Irwin previously spoke about the importance of “laughing at yourself”.

Irwin’s comments made barely two years ago in a 2022 One Plus One interview with the ABC was revealed when the clip was played by entertainment reporter Peter Ford on The Morning Show on Tuesday."

...

“It’s being able to laugh at yourself, it’s being able to go ‘that’s the fluff’ and the opinionated stuff — people will always have their point of view,” Irwin said, during the interview.

It was a perfectly legit question to your claim that it was illegal to impersonate someone, we all know it's not except in some real life situations like impersonating a cop. You can still do that in comedy though.

You made a statement and you were wrong, just wear it and perhaps use better wording next time.

He's a dual citizen of Australia and the US.  But yes, I agree he is probably more Americanised due to his mother.  I'm pretty sure if Steve Irwin was still around we probably wouldn't be having this conversation.

I'll bet you we would be.  He was also a very precious puppy, rightfully protective of his 'brand.'

I'll bet anyone this whole thing has now been settled and the terms are confidential, and Hanson/Ashby have agreed not to rip off the Irwin name/brand again.

I trust the brand owners of Bluey have also done the same.

How exactly is Hanson: Irwin different from a newspaper cartoon which demolishes the political reputation of a PM?  (Implied free speech in constitution). Is the Bluey shape a registered trade-mark?

No, he and everyone would laugh when it was shown that you're just projecting, the evidence is already out there. I've argued against your ridiculous "final solution" before. The evidence in in your posts, no matter what you posted as FD would be shown to be false, as his posts would show.

In fact the Jews who would be killed because they would not listen to your beautiful solution are much like rape victims who do not listen to the oh so logical, "don't dress like a slut if you don't wanna be raped" position. Just relocate, just cover up all your probs will be solvered. You're a loon.

Irrelevant twaddle.

No one was passing anyone off as anyone else.

Irwin & Bluey are Ambassadors for Tourism & Events QLD ... aka the Govt.

As such cartoon characters of both(Bluey already being one) were used to satirically parody govt policies & actions.

'Bluey and the backdrop of Brisbane has captivated audiences globally and now it's time to bring the world here to Queensland — Bluey's world for real life," Mr Miles said.
When asked what he likes most about Bluey, Mr Miles said: "I just love how much fun they have".
Robert agreed with a giggle and cartoon he got from Pauline.

I have to admit, I have not paid a great deal of attention to Bob's shows. I have watched a few videos of him on youtube. He comes across as likeable. Rorie dumping Robert some time back would still be hurting Robert. And this bullshit with Pauline would probably be irritating Robert. We could probably see Robert react negatively, if Sam Pang heckles Robert at the Logies.
