In Australia even if someone had genuine death threats made against them -
they are not allowed to buy a gun to defend themselves. Their only legal solution to avoid being murdered would be to go overseas and change their name. If they did use a gun to defend themselves and killed an assassin they would be charged with murder and gun offences. |

To put this as simply as possible, you have the right to self defence as long as the force used is reasonable under the circumstances. So if you kill someone a court will decide if this was reasonable or not.

Why the fixation with guns?
The law prohibits the possession of ANYTHING for the purpose of self defence. And where you keep it can alter its classification, in one room of the house it could be legal but if kept in another room it could be illegal. |

'Excessive self defence' in other States means the right to shoot is limited even when fearing grievous bodily harm. The self defender is then charged with manslaughter.
In Qld 'This protection [right to shoot] does not extend to a case in which the person using [self defence] force which causes death or grievous bodily harm first begun the assault with intent to kill or to do grievous bodily harm to some person; nor to a case in which the person using force which causes death or grievous bodily harm endeavoured to kill or to do grievous bodily harm to some person before the necessity of so preserving himself or herself arose; nor, in either case, unless, before such necessity arose, the person using such force declined further conflict,'. |

In Queensland, the maximum penalty for manslaughter is imprisonment for life, plus 'If the person unlawfully possesses a short firearm in a public place without a reasonable excuse—1 year's actual imprisonment. i. If the person unlawfully possesses a firearm and uses the firearm to commit an indictable offence—9 months actual imprisonment.'

Britain will pin your right arm down and call you a $$$ criminal
USA will pin your left arm down and call you a racist criminal Both will allow an Aborigine to belt into you for considering yourself 'australian'. Self defence is basically apply a use of force to either push the assailant away or restrain without physical injury. It's basically a one punch rule, to void further attack. If the attacker comes again, then only 'one punch' etc, again. The best way to 'belt' an assailant is in the bread basket - because it doesn't leave any 'marks' for the attacker to claim 'assault' against you. As are restraining manual handling techniques. Remember that guy who got charged with assault for hitting a home intruder with a baseball bat, in his own home? Yeah - this is Australia: where the 'criminal' is protected. Used to be by the British, but now its by the Americanised legal culture, especially if the attacker is 'black'. Personally, I would rather be charged with 'whatever' than be dead. But hey, that's just me. ;) |

Under our rules for not possessing anything for self defence would come a cricket bat in the bedroom but if it’s signed by a notable team or a well known cricketing individual, or even the local team then it’s a valued souvenir and may be kept in the bedroom or the lounge room, same goes for baseball bats.
Deodorant sprays are OKbut should be gender specific, insect sprays can be anywhere; oven spray, which is a particularly nasty weapon, should only be in the kitchen or at the barbecue. Walking sticks can be carried anywhere but it helps to look old enough, and they are marvellous for defence. |
