Woman jailed for $90,000 Centrelink fraud

A woman who abused Centrelink payments of more than $90,000 has been jailed for two years after a Perth judge accused her of faking a seizure in court.

Claire Louise Kell, 41, pleaded guilty to fraudulently obtaining $90,326 in parenting payments between June 2003 and October 2010, and providing false information to dishonestly influence a public official.

Kell appeared to have a seizure in the WA District Court on Wednesday and her lawyer said Kell had recently been diagnosed with epilepsy, although she could not confirm it.

But Judge Philip McCann seemed unimpressed, commenting that it was an 'interesting seizure'.

'It's a remarkable coincidence, isn't it really, that we're now being told about epilepsy and having regard to the fact that she is a proven fraud, has been investigated in the last eight months for various neurological disorders and found to be perfectly fit, and we have a working diagnosis of conversion disorder,' he said.

'I would not accept a word she said unless it was corroborated by someone reliable ... I think she's a complete liar.

'I just think that was fake what I just saw and judging by the way that Ms Kell is glaring at me, I think she fully receives what I'm saying.'

Judge McCann noted Kell had been under medical observation for seizures, but said based on the evidence and what he had observed, they were pseudo-seizures from her conversion disorder.

He also commented that Kell had made a selfish decision to not attend a psychiatric appointment, instead going to see a dentist to treat a painful broken tooth.

Judge McCann said Kell's fraudulent offending was motivated entirely by greed, but she had a history of psychiatric illness and her personal situation required a humane approach.

'This was a lengthy, wilful and egregious cause of fraudulent conduct,' he said.

Kell must serve a minimum of 12 months behind bars before she can be eligible for parole.

Could Centrelink reimburse me the $2400 in lost payments that I should have had when I was unfairly dismissed for sticking up for myself? They are very strict about cracking down on people who actually need the money.

They can go back 10 or so years on you to reclaim, but you only get 3 months to get anything they owe you.

That's chicken feed to our greedy pollies.

They could spend that in a month on living away from home allowances.
Or giving money to useless, parasitical senior public servants.
Or throwing money at countries that hate us (Multiply the amount by 1000 or more).
Or howard the cowards expenses on an office he don't need, staff he don't need oxygen we don't want him to breath.

Our corrupt, narcissistic, bombastic, elitist and corrupt grubberment really needs to be cleaned out.

Preferably with a flame thrower.

the govt. would be better served cracking down on people hiding money and assets from creditors and the ATO just before pretending they are bankrupt so as to avoid paying creditors (called phoenixing)  ... there is much more to be added to the govt. coffers that way.



The ATO, Australian Federal Police and other federal authorities have formed a taskforce to tackle phoenixing, which is estimated to cost the Australian economy more than $3 billion a year.

I went to Fair Work Australia to see what I could do about this. The mediation process went to the point where because my boss purchased the business 4 months earlier, I was not in a position to make a claim. Allegations of sexual harassment against me were unfounded and ridiculous. But allegations of sexual assault against my former coworkers by the supervisor who fired me were never followed up until a year later.

I tried straight away to claim the 8 week period that I was not allowed to get a payment (especially considering I did not have a job for 2 weeks). I had to rely on a modest bank savings to get me through a 3 week period (getting a small pay the next week for the work I did do). When my former work conceded that they were in the wrong, they decided to update my separation certificate to make it seem like my job was redundant and within the 6 month period. Showed Centrelink the next day, and they did not give a fluck. Bitch on counter was super strict about anything damning against a customer. Nothing was done to regain my payment for the 8 weeks.

I am not part of a union. I complained to head office. I could hear the staff member typing away my complaint. After about 30 seconds of typing, she stopped typing and started acting like it was some kind of butt hurt complaint. I bet the company got a lot of these types of callers. No wonder the company went bankrupt.

A union could've assisted you with this and provided free legal assistance, they deal with unscrupulous employers daily and happily nail them to the wall  . Give it some thought , dues are 100% tax deductible as well  :)
