Clive Palmer refinery: Taxpayers face multi-million-dollar bill to clean up Queensland Nickel site

Source ABC Network:

Exclusive by the National Reporting Team's Mark Willacy

As well as potentially paying out sacked workers' entitlements, taxpayers could be forced to stump up tens of millions of dollars to clean up the site of Clive Palmer's north Queensland refinery if the company cannot trade its way out of voluntary administration.

Key points:
•The clean-up bill at the Queensland Nickel may reach $40 million, Government says
•Opposition claims it could reach $300 million
•Taxpayers could be forced to foot the cost of rehabilitation
•The Environment Department does not hold any bond for the site

Queensland Government sources have told the ABC that the cost of remediating the Queensland Nickel site, at Yabulu, could be anywhere from $25 million to $40 million.

Former owner BHP believed the environmental clean-up cost may exceed $100 million, while the Queensland Opposition said the clean up bill could be "upwards of $300 million".

Opposition environment spokesman Stephen Bennett said taxpayers were in danger of being left to foot the cost of rehabilitation if Queensland Nickel was forced to close the refinery.

Queensland Nickel called in administrators earlier this week, and the state's Environment Department has told the ABC that it does not hold any environmental bond for the refinery site "because financial assurance is not applied to businesses of this type".

"While the state does not hold a financial assurance bond, the company's environmental authority contains conditions to ensure that rehabilitation is conducted in accordance with [department] guidelines," the department said.

The department said there were also specific requirements for Queensland Nickel to rehabilitate the refinery's huge tailings dams, which sit on the edge of the Great Barrier Reef World Heritage Area.

The dams contain high levels of ammonia and other waste.

Premier Annastacia Palaszczuk said she had asked for a report on the state of the site.

"We've already asked the Department of Environment, which comes under Resource Management, to be looking into that matter. They are taking that as a key issue and we'll be updated on that at Cabinet next Monday," she said.

Plant's closure a 'risk' to Great Barrier Reef

Townsville Mayor Jenny Hill expressed concern that there could be repercussions for the Great Barrier Reef if the plant were to close.

"While the plant is operating we have people on site and part of their role is to maintain the assets," she said this week.

"If the plant wasn't operating there is a greater risk for the reef and the environment."

Queensland's Environment Department said that under Queensland Nickel's environmental authority there were specific requirements for the company to restore disturbed areas so that they were "safe to humans and wildlife".

But the Australian Financial Review yesterday reported that six months before Queensland Nickel went into voluntary administration, Mr Palmer's company decided it did not need to clean up fully around the Townsville plant and only needed to restore the site so it was suitable for "industrial use".

The refinery at Yabulu has had a chequered environmental history.

Last month a magistrate ordered Queensland Nickel to stand trial for alleged breaches of environmental regulations. It is alleged one of the refinery's tailings ponds overflowed last year.

The company has indicated it will plead not guilty to the charges when the case returns to court this year.

The clean up costs of mine sites should be paid to the government to be put in trust for safekeeping as they earn from the sites.

Half the open cut sites around Australia will never be cleaned up I suspect.

Funny thing Cods, the other day on Mythbusters about the movie Titanic, and whether Rose and Jack both could have been saved on that floating wooden panel, rather than just one person....in the end, if a life jacket is tied around the panel so it's on the underneath, is the only way it could have stayed afloat with both of them....
Then it got me thinking, wasn't Clive Palmer doing the Titanic 2, and haven't heard much about it of late.

I often think a name or something relative to an ill fated vessel, kind of gives me that ominous feeling.

Sorry, have changed the subject :)

He has already built the Titanic II.  Then he called it PUP.  Same outcome. Arrogance, mass expense and utter failure.

Enjoying your PUP membership, Aussie?

Do you follow any news at all cods?  Dio Wang today was reported confirming his support for Palmer.  Membership of PUP was free when I joined.  I insisted on paying a fee, and was charged either $10.00 or $20.00.....can't remember which.

If he has only about 25 Members, cods, the Party would be de-registered.  Do you enjoy just making pure crap up and posting it?

Gives some sort of feeling of having made a valuable contribution to a discussion, does it?

I dont give a poo how many members he has.. they would all be short of a shingle or two...and by now well on their way to claiming a refund...

only really thick people would have ever joined up for more than 6 months...serve them right...they want to go down with the titanic..its their problem not mine..

I bet Lambie and Lazarus are high 5ing each other... what a close call...he wont get elected again... even if he does have the balls to run again.

More personal abuse....but you won't see it that way, will you, cods.

How do you refund 'free,' cods?

Again....you show how ignorant of the facts you really are.  Today's Newspapers up here were reporting his intent to run again.  So what does that do to your comment..... even if he does have the balls to run again.

I highly recommend you just not post on matters your have no idea about, so much so, that you have to make up garbage you accuse others of posting here.

I hitched myself to a Party which destroyed Campbell Newmann and successfully disrupted the cosy little duopoly which is what we have in Canberra.

Whether they are PUP Senators or not now, the presence of Lambie and Lazarus in the Senate (thanks to PUP) took away the absolute power the Libs would otherwise have had in this Country.

If I have got any of that wrong, I look forward to you pointing me in the direction of enlightenment.  Go on, have a go Elde Fruit.  I am all eyes.

Not one bit.  PUP has destroyed Newmann's Government and made it not so easy for the Libs to do what they want in Canberra.  I'm quite happy with those two outcomes, thank you very much for your so obvious and sincere concern for me.

Newman destroyed himself. Palmer however sent $50M (not all his own money) to end up with one senator who never speaks and one MP too lazy to even attend Parliament.

Worst Political Party ever. PUP makes One Nation look professional and competent.

You must be feeling ripped off as do 80% of former PUP voters who have abandoned the party. Its a 1% party now, far less than Family First. In a few years there will be no PUPs left. There is already no PUPs with any influence.

I have highlighted the only part of that I think I understand.  What does the 'L' stand for codsy wodsy (etc.?)  There is a Coalition (of which parties?) to which Palmer made major financial contributions.  If they wanted cash, they went to Clive.  Ask your special friend and pal Mal Brough.

Have to give you some credit, codsy wodsy (etc.)  It's been a while since you brought 'thomo' in.  Pity doing so destroys your own point.  He has not been a Member of the ALP for quite some time.

Really?  What toys for which boys?

I reckon that would be very mutual.

Palmer is as left wing as I am an eskimo.  In fact, he is closer to Abbott than Abetz is on political issues.

The difference is obvious.  Slipper was charged, convicted and then exonerated of having his fingers in the tax payers till.  Palmer has his hand in his own pocket.

He is a very long way away from being dumb, codsy wodsy (etc.)  We ought damn him for being clever, successfull  and cunning.  I know we should.

Everyone has.  It is a statutory requirement that Members of Parliament make full public disclosure of their entire financial position.  I'm not surprised you did not know that codsy wodsy (etc.)

When you look at Clive do you see a happy well adjusted person or some grotesque form heartbeats away from that big attack that will claim him.

Speaking of Clive...... (sorry to interrupt)....

https://au.news.yahoo.com/a/30640748/palmer-pledges-250m-for-nickel-refinery/

"Clive Palmer says he has put forward $250 million worth of assets for his ailing nickel refinery and is confident it can trade out of trouble.

The businessman-turned-politician says the assets have come from two of his other companies, Waratah Coal and China First, and include "proven" coal deposits.

The companies also applied to become secured creditors for Queensland Nickel just before 237 jobs were shed from its refinery near Townsville.

In an interview with the ABC, Mr Palmer also described the job losses as "tragic" but part of attempt to keep the operation going and ensure the future of 550 other workers at the refinery.

"We're heroes, not villains," he told the ABC.

"I think you'll see it come out of administration stronger, leaner, fitter, ready to go on."

Mr Palmer said there was a nine out of 10 chance the Yabulu refinery would remain open.

The mining magnate said the $250 million worth of assets were needed to keep the refinery afloat although they weren't secured.

He urged the federal and Queensland governments to follow suit.

"I'd just like to challenge the premier and the prime minister to match me, dollar for dollar, to support Queensland Nickel," he said.

Queensland Nickel went into voluntary administration on Monday and has debts of about $70 million.

The Australian Workers Union tried but failed to convince the Queensland treasurer to guarantee a $35 million loan to protect jobs at the Yabulu refinery.

But the state government insists the request couldn't be granted because Mr Palmer wouldn't open his books.

Earlier this week, the federal MP promised to write to every household in the Townsville region to "tell the truth" about what happened with his nickel business, which has donated more than $20 million to the Palmer United Party over the past two years.

A creditors' meeting is due to be held in Townsville on January 29 and it is understood several Australian and overseas firms are weighing up a possible purchase.

The federal government has offered a $500,000 package to help former employees find work."

Let's wait and see - in the meantime there are no other sources of funding (if this is such) coming from anywhere.  It's all assets - not sure how that works in nickel foundries.... need to see the fine print as you say... maybe he's saying they can have the backing of these coal reserves of whatever as collateral.

for the monies he pinched out of QLD Nickel, the dodgy property deals he did using the company, the fact that he won't pay sacked employees their entitlements & has failed to pay their Superannuation since November ...

should warrant criminal charges ....

then there's the 12 million he pinched off his Chinese backers.

Jabba 'The Hut' lives in the form of Clive Palmer.

Will always remember the piece the media   they did on his guest house complex.

His son asked him for the car keys and Palmer chucked them at his feet. His son was managing the complex at the time.

I thought 'that says it all' about that fat slob.

That's correct. As the sole shareholder he is entitled to.  What do you reckon the outcome of any shareholder's meeting would be?

If he has lent to the Company, yeas, he is a creditor of the Company.

Nah.  The Company is solely responsible for its debts.

Incorrect.  The Company and Clive Palmer are separate and distinct legal entities.

Queensland Nickel: Clive Palmer 'could be liable' if he acted as QNI 'shadow director', lawyer says

Quote:
Clive Palmer could be held personally liable and face a hefty compensation payout if he is found to have operated Queensland Nickel as "shadow director" while the company was insolvent.

The billionaire MP has warded off accusations he has been secretly running the troubled refinery, maintaining that he retired from the company in 2013 when he entered the political arena.

But Mr Palmer admits he did remain part of an expenditure committee, and signed off on company purchases using an email under the name Terry Smith.

According to corporate law Professor Ian Ramsay of Melbourne University, it is possible for "director's duties" to be imposed on people who are not properly appointed as a director.

"If they are found by a court to be either a de facto director or a shadow director and also found to have breached their duties, that person can be personally liable and possibly be held to pay compensation," he said.

Professor Ramsay said if Mr Palmer was found to have been operating in the capacity of a director of Queensland Nickel, the implications could be significant.

"In particular, important director's duties apply to that person, and if a court finds that one or more of those duties are breached, then personal liability can be imposed on that person."

Professor Ramsay said "director's duties" included the duty to exercise reasonable care and diligence, to act in the best interest of the company, and not to have their company trade while it is insolvent.

That's almost as funny as the way you're defending him Aussie.

I am not 'defending' him.  I'm pointing out the facts.
First you talk about him being the sole shareholder so he can do what he likes with the profits ...

That's correct. As the sole shareholder he is entitled to.  What do you reckon the outcome of any shareholder's meeting would be?

Quote:
The company is in trouble ..... the receivers are in ....

and now he's one of the creditors?

If he has lent to the Company, yeas, he is a creditor of the Company.

Too ferkin funny Aussie ... fairdinkum ... last shower & all that ......

So that's water on you.  I thought you were salivating that Clive is copping flack.

Quote:
His company QLD Nickel of which he is sole shareholder of therefore the owner & solely responsible for it's debt owes rail company Aurizon $27 million alone for rail cartage

Nah.  The Company is solely responsible for its debts.

Quote:
he's not a creditor .... he's a debtor.

Incorrect.  The Company and Clive Palmer are separate and distinct legal entities.

Like him you're all for smoke & mirrors bullshyte to hide the truth.

The  smoke and mirrors are from the hostile and politically motivated Murdoch schmedia empire which has been chasing Palmer for at least three years, painting him in the worst possible light in every scenario.
And again with the comedy routine  ;D ;D ;D

Palmer has been doing his own painting in bad light just by his actions.

You ought pick yourself another poster boy

aussie rushed to join this motley crew..called PUP.. yep even has PALMER in the party name...well I never!!!

anyway he voted him in..couldnt praise him enough..even when certain things were pointed out...like the 100 people who lost their jobs when he took over Coolum resort...didnt matter Clive was the best thing to hit fairfax and Qld...

now of course he is still flat out making excuses for him.. its all Murdochs fault of Tony or Newmans...

the moment Mitchell Pearce blamed grog he lost me...and its the same with pollies..

the moment its someone or somethings elses fault

total rubbish,... they are not fit for the job...simple really..

I expect more and better from people who put themselves in high places....

..and when they sudden ly think they are untouchable...

that really pizzzzzzzzzes me of...get out you dont deserve what you have..

this bloke is so used to getting his own way by BULLYING by threatened all and sundry they will be sued....is BULLYING by a thug....

I didnt elect him..  I have more respect for my vote....but if you did..

STOP MAKING EXCUSES FOR HIM>>
