Couldnt happen to a nicer turd!

Hockey liable for 85 percent of legal costs in Fairfax Media defamation case

Treasurer Joe Hockey will be left to pay 85 percent of his legal costs after his defamation case against the Sydney Morning Herald and The Age.

Federal Court Judge Richard White this month ruled Fairfax defamed Mr Hockey when the words "Treasurer for Sale" were used on a promotional poster for the Sydney Morning Herald on May 5 last year.

Mr Hockey was awarded damages of $120,000 for the poster and $80,000 for two similarly worded tweets from The Age newspaper.

But today, Fairfax Media was ordered to pay just 15 percent of Mr Hockey’s costs in relation to his claims against the Age and The Sydney Morning Herald.

Earlier the judge dismissed Mr Hockey's claims over the content of the articles themselves, published in the Herald, Age and Canberra Times.

He said the articles were of "considerable public interest".

Justice White said Mr Hockey - who had taken the Age, the Sydney Morning Herald and The Canberra Times to court - had failed altogether in his claim against the ACT paper.

But he rejected Fairfax's submission the treasurer was unsuccessful in his proceedings against the Melbourne and Sydney titles.

Mr Hockey was not in court during today's proceedings.

It is likely that Mr Hockey will be out of pocket from the legal proceedings following the costs ruling.

Justice White dismissed claims by Mr Hockey that Fairfax had been unreasonable in not settling the matter before it went to trial.

"It cannot be said to have been unreasonable for the SMH and The Age to refuse to agree to a settlement requiring them to pay damages significantly in excess of the liability found against them," Justice White added.

It comes after Mr Hockey's barrister Bruce McClintock SC told a costs hearing earlier this month that Fairfax should pay at least 95 per cent of their costs.

But Fairfax's barrister Sandy Dawson said the case "was an unmitigated disaster for Mr Hockey and a costs order should reflect that".

He argued Mr Hockey should be footing 60 percent of their bill.

Justice White said that it was plain Mr Hockey was not entitled for his costs in the matters against The Age and the SMH to be paid in full, as "he failed on the matters which were the real core of his claim".

Had he just sued the publisher over the poster and the two tweets, the matter may not have gone to trial at all, Justice White said.

Mr Hockey was awarded damages of $120,000 for the poster and $80,000 for two similarly worded tweets but his claim over the content of the articles was dismissed.

The articles said Mr Hockey gave access to a select group in return for donations to the Liberal Party via the North Sydney Forum, a fundraising organisation whose activities were not fully disclosed to election funding authorities.

The treasurer may have to be for sale to pay that bill. Or he can sponge off his Mrs , he best pay it off before election, like Costello I can't see many knocking down the door to secure his services.

I thought I would rehash the actual allegations contained in the Fairfax article which where found to be truthful by the court....Hockey has done his reputation no favours by giving the story validity....Smoking Joe has proven the allegations by taking it to court and losing out on the most substantial aspect of his law suite....Hockey sells his fat ass for privileged access!!!

Quote:
Treasurer Joe Hockey is offering privileged access to a select group including business people and industry lobbyists in return for tens of thousands of dollars in donations to the Liberal Party via a secretive fund-raising body whose activities are not fully disclosed to election funding authorities.

The Independent Commission Against Corruption is probing Liberal fund-raising bodies such as the Millennium Forum and questioning their influence on political favours in NSW.

Mr Hockey offers access to one of the country's highest political offices in return for annual payments.

The donors are members of the North Sydney Forum, a campaign fundraising body run by Mr Hockey's North Sydney Federal Electoral Conference (FEC). In return for annual fees of up to $22,000, members are rewarded with "VIP" meetings with Mr Hockey, often in private boardrooms.

The North Sydney FEC officials who run the forum – which is an incorporated entity of the Liberal Party – say its membership lists and therefore the identities of its donors are "confidential". Mr Hockey also says details of who he is meeting and what is discussed are confidential.

What little public information is available reveals members of the forum include National Australia Bank as well as the influential Financial Services Council, whose chief executive is former NSW Liberal leader John Brogden.

The FSC's members, including financial advice and funds management firms, stand to benefit from the changes to the Future of Financial Advice (FOFA) laws being considered by the federal government, which would involve a winding back of consumer protections introduced by Labor.

The National Australia Bank would also benefit from the changes.

Not really!!!

http://www.dailytelegraph.com.au/news/breaking-news/hockey-defamation-claim-partly-upheld/story-fni0xqi3-1227421987785

Quote:
A THREE-WORD headline and two tweets have cost Fairfax Media $200,000 after Treasurer Joe Hockey successfully sued for defamation.

MR Hockey sought substantial damages over the publication in May last year of a story about the North Sydney Forum, a "secretive" political fundraising organisation in his electorate.

The article was run in three newspapers - including under the banner headline "Treasurer for Sale" on the front page of the Sydney Morning Herald.
Federal Court Judge Richard White ruled the words "Treasurer for Sale" in large bold print on an SMH advertising placard were defamatory and Mr Hockey is owed damages of $120,000.

Two similarly-worded messages posted by The Age on Twitter were also deemed defamatory, with damages set at $80,000.

But Justice White did not uphold Mr Hockey's claims regarding the articles themselves.

The treasurer launched three parallel actions against the publishers of the SMH, The Age and The Canberra Times over the articles, related posters and tweets.

The articles said Mr Hockey was providing privileged access to a select group in return for donations to the Liberal Party via the North Sydney Forum, and that the forum's activities were not disclosed fully to election funding authorities.

What a clown. No one this naive should be the treasurer of a country. He had any number of good legal brains amongst his political colleagues who could have advised him as to his prospects for a win in this defamation case.

"Justice Richard White found that a poster headline and tweets reading "Treasurer for sale" were defamatory.

All other claims made by Mr Hockey were dismissed".

And then to compound his idiocy he turns around and insults the rest of us by  saying ..

"The Federal Treasurer says he does not regret taking legal action against Fairfax Media, despite losing his bid to have the media organisation cover the costs of his defamation suit".

We believe you, Joe. Of course you have no regrets about losing this case that leaves you not too much short of three-quarters of a million dollars. Wouldn't anybody be happy to walk away from a Defamation case in the position you find yourself now?

Not to mention the crux of the story remains unscathed , not a good look selling your time to wealthy north shore businessman trying to influence legislation while your supposed to be representing the people of Australia, not a select few. This must be very embarrassing for you righties.

I'm not a 'righty'. I don't have an 'ideology'. Commonsense and rational-thought is all I have in my political toolbox.

Didn't say you were, it was another opportunity to hop in to the righties , punishment for voting in this rabble you see.

I hate 'righties' as much as anyone. Genocide ... dictatorships .. skinheads ... muggers ... burglars ... rapists ... paedophiles ... etc etc
