Uber drivers are avoiding the airport’s $2.70 levy that taxis are forced to pass on to passengers, bypassing cabbies stuck in a waiting yard and heading straight to the terminals for pre-booked fares.

Taxi Services Commission tsar Graeme Samuel said Uber was proving impossible to stop.

“In one sense, what Uber is demonstrating is how hard it is to stop someone using digital technology,” Mr Samuel said.

“I have empathy for those (taxi drivers) facing challenges but I just don’t think you can ban people using apps.”

In an emailed statement, Uber spokeswoman Katie Curran blamed “outdated rules’’ at Melbourne airport which favour the “incumbent industry’’. But she would not elaborate on the rules, nor would she return phone calls, requesting questions by email only.

But Melbourne airport spokeswoman Carly Dixon said the airport did not regulate Uber and had not made any rules to block its cars.

A Sunday Herald Sun investigation found a trip from Tullamarine to North Melbourne cost $21 less in a UberX compared to a taxi last week.

We did a cost and time comparison for four Melbourne journeys including airport routes. Taxis were twice the cheaper option.

Victorian Taxi Association spokeswoman Georgia Nicholls said: “All that Victorian taxi businesses seek is a level playing field. Meaningful penalties must be introduced and enforced against those who openly choose to flout the law and endanger public safety.

South Australia has banned UberX. Victoria’s Transport Minister Jacinta Allan has sought advice from the taxi regulator about the company.

Passengers use a mobile phone app to order an UberX car and drivers use their own vehicles to ferry passengers.

Passengers receive a fare estimate upon booking and no cash changes hands with the price deducted from the credit card hooked up to the account.

Unlike taxi drivers, they are not required to buy expensive “taxi plates” or pass strict knowledge tests. The Taxi Service Commission has fined 80 illegal cabbies but Uber has paid all infringements.

Backed by giants such as Google, the ride-sharing service runs in 50 countries and across 250 cities.

Uber has defended its practice and says each car is roadworthy, insured and drivers pass criminal checks.

Uber is a 'threat' to the industry and that is quite okay by me.  All we want is that they are required to play by the same rules we (taxi owners/operators/drivers) have to play by.  For example:

1.  Driver training.
2.  Security including lost property provisions.
3.  Regular vehicle safety inspections and certifications.
4.  Be subject to random inspections at any time.
5.  Be subject to random administration audits at any time.
6.  Licencing of drivers and regulation of them, including health checks, behaviour checks, security checks, police checks and general supervision checks, including methods of dealing with customer complaints.
7.  Proper and appropriate 'plate' licencing.  That is.....like we have to, pay for the right to offer transport to the public, not assume it.
8.  Pay so that anyone a Uber driver harms through negligent driving is covered by regulated insurance.  We pay near to $7,000.00 per vehicle to get rego/insurance so that if we harm you, you are assured of compensation.
9.  Pay what we have to pay to comprehensively insure the vehicle against third party property damage...presently around $5,000.00 pa.
10.  Pay all the airport taxes we pay as a matter of course.
11.  Have a proper documented contractual arrangement with drivers.
12.  Pay to have them insured if they are injured in doing their job.....similar to work cover.
13.  Provide proper security arrangements for any customer who gets in the car.....through internal cameras, audio technology.....that also costs money.
14.  Ensure there is no ad hoc 'spike demand' cost increase for use if there is some unusual event, as Uber did when that Lindt Cafe incident occurred.  Taxis do not increase rates if it is flooding, cyclonic, earth quacking, burning or whatever.  We are out there.

Do all that.....not a problem.  Nothing wrong with competition, provided we are all singing from the same prayer book.

Bring fair competition on and that's fine by me and everyone else in the industry.

But, it is my expectation that Governments will take action against anyone, including Uber, which is acting outside the law.  That is what happens in Queensland and it is costing Uber money  big time.  I'm sure Google (who 'owns' Uber) has plenty of money, but it ain't a bottomless pit.

If everyone plays fair, let the better service prevail.

No doubt about you cods.  You have a deep and solid understanding of the issue beyond your own personal requirements.  When was the last time you rang for a cab, and it did not turn up within ten minutes?

You mean play by your rules ?

As for a level playing how about a rail link from Melbourne airport to the city ? I believe this taxi monopoly is one of the reasons why after 40 years we still do not have a rail link to the airport and I don't believe that is a level playing field :(

This is what is so wrong with the world today, too much government regulation, as a business owner your first priority should be to get the idiot government the hell out of your life but obviously you just like taking it up the arse from them.

What you have posted is a list of government kickbacks that the government mafia has awarded themselves, a bunch of red tape designed to tie you up in knots while enriching the useless.

Hopefully Uber cuts the government out of the picture altogether but its a tough job, the government are a pack of fascist arsehole mafia types that like to threaten business in order to get protection money and kick backs.

Yes and those are the rules that a traditional taxi service has to work under. They never envisioned a service like Uber when they made those rules ;)

And that illustrates how Uber is circumventing the Law.  No problem doing that, if there is no charge, but the instant that private car charges....that makes it illegal and dangerous for the customer.

And to pick up on the other point I think you are making.......do you really reckon, when there are a "thousand" taxi eyes out there watching what goes on every hour that anyone who keeps turning up is not going to be noticed?  Do you really reckon the Industry and the Government are not using undercover people who ring Uber to expose the illegal cars and their drivers?

Do you really reckon, especially where I operate, any Uber car operating illegally would have four inflated tyres any and every morning?  How long do you reckon an illegal Uber driver would last doing his illegal activity in 'frontier land' where the local posse might do what the outlaws are doing and take the Law into their own hands?

The taxi industry entered into a pact with the devil ( otherwise known as big government ) and decided that together they would rip everyone off and divide the spoils, now that model is under threat and the government may need to cut the taxi industry loose so that the taxi industry can wander off to the taxi industry elephant grave yard to wither and die out of sight out of mind while the government devil makes a new pact with Uber.

I think you are trying to put on a brave face whilst hiding behind an outdated business model where its survival is dependent upon legislating away any competition.

As far as illegality is concerned Uber has deep pockets and is willing to cough up any fines on behalf of its members.

What's in it for me apart from a better deal ?

As far as screwing people over you need to consider how long we the melbourne general public have been screwed over by not having a rail link from the airport to the city and having to pay $150 for a taxi ride for a trip which should only cost no more than $30 by train !!

It will be a sad day if the government legislates against progress. That's the sort of thing you'd expect from a bunch of Luddites but seeing the taxi monopoly has got its way so far I wouldn't be surprised :(

The Government is not protecting the taxi industry at all.  It is doing what Government does.....enforce existing law.  Uber can pretend it is a girafe all it wants, but it is a taxi service, and must meet the regulatory obligations Government imposes on such services.

Simple.

As I have said, the Industry is not scared of another Cab Company.  They come and go like as has happened over the years in various parts of metropolitan and rural Queensland.  But......any new arrival needs to play on the same field as the rest of us.  No free kicks, Uber.  Comply with the Law.

The real problem is that the government mafia has muscled in on your turf and now you have to pay the government  mafia hundreds of thousands of dollars in protection money before they will allow you to do business on their streets, the  problem began when the government mafia got involved, like the italian mafia they are just after kick backs so that they don't have to get a real job like driving cabs.

You have to get the government mafia out of your life, support small government and put that lazy government scum out on its arse and on the dole where it belongs.    ;)

That'd be great, but totally unrealistic.  I cannot see any Government handing back to Industry any amount let alone one probably well over a Billion dollars.

$350 000 for a taxi licence, thats just insane!!!, and how did we get to such insanity, government interference thats how, once you get government to solve a problem that problem will become inherently worse. 

The government is trying their best to protect their investment, ie you, but if push comes to shove they will dump you and 99.9% of the public won't give a sh!t.

Its kind of like pre WW2, first they came for the jews and we said nothing, and now in circa 2015 when they come for the taxi drivers that have paid $350 000 to the government mafia for a protection racket we said nothing  ;D

The wheels of justice will grind exceeding slow but in the end the Ubers & Air b&bs will comply with the law or suffer the consequences.

Yes at the end of the day the government mafia will rule because unlike the italian mafia there is no one above them to round them up and lock them up.

Is a good lesson on how much cheaper and simpler things would be though if we didn't have to pay off the government mafia.

Did you hear about the dude who picked up a ride only a couple of k's froim the airport ? The taxi driver had a hissy fit when he found out that it wasn't his standard run to the city and he had lost his place in the ranks !! Great professional service :D LOL

This is what happens when you not only have to work to look after your own family but also have to work to look after the government  mafias families too, all of which do not wish to become taxi drivers or uber drivers for that matter but instead want to become government parasites feeding off the workers instead.

The government is a tick.
