Illegal Immigrants are costing us at least $60m every year on legal fees to provide them with free legal advice. That number is surely going to rise as more and more boats come prior to Tony Abbott becoming PM. It is just disgraceful that this ALP government continues to to take the low road by playing politics with this issue when they have a clear, proven solution right in front of them but won't use it - because it is a Coalition policy.

Which solution is that? As far as I know both government and the Noalition are as one on their policies for asylum seekers.

They are - they skip over perfectly safe countries during their journey here. If they just wanted somewhere to seek asylum, they would find the closest safe country and that would do. But noooo - they want Australia only and no other country will do. I noticed a picture of a kid on a boat holding up a cardboard sign asking, "where will we go?" and the answer to that is another question - "why come here instead of somewhere closer to home?"...

Indonesia has not sign the Refugee Convention so it is not a safe place for Refugees.

I didn't say all australia had to offer was the dole - but the 85% who are still bludging 5 years on seem to think so.  You claim to have "no idea" what they do when they get here?  Puh-lease...you know very well, but again, it doesn't fit the narrative, so will be ignored in true leftist fashion.

Besides, shouldn't we be thinking about what is "best" for us - not what is best for urchins who have already ruined their own countries?

Forgot Howard's Pacific Solution, Nauru, temporary visas?

Howard stopped the boats but that was the Coalition's dodge that KRudd would not wear.

So he opened the gates, a littler wider this time, happy in the thought that it would help bankrupt Australia -

Gillard is happy continuing this stupidity and Labor supporters (a dim lot) still give her thumbs up.

I wonder if Graham Richardson and Bob Carr (a pair who use their brains) are happy seeing all this money going to accommodate parasites while our own sleep in tents, motor vehicles or under a bridge.

It was labor who allowed non citizens to get legal aid while a white man with a job probably wont qualify for legal aid.

Lol.  It does not behoove one of your calibre to be so condescending.  In one way, you are correct, the table is for upto 5 years. As you pointe dout 4-5 years has a figure of 83.5% - but the way you worded it "upto 5 " years suggests anywhere between 0 - 5 years.  

What's the figure for, say 1 -2 years?  Up around 90% innit?  Gradually (very gradually) declining...We could extrapolate from that - if it takes 5 years to decline from 90 - 83.5, we could figure that after 19 years, it'd still be somewhere around the 70% mark.

Exactly. Asylum seekers are precisely that - people who seek asylum elsewhere until it is safe for them to return home. Their money is no good for migration purposes. They could not get any kind of visa, not even a tourist visa, to come to Australia, let alone meet the entry requirements as legal immigrants.

That is why they are travelling legally only as far as Indonesia and then ditch their IDs and come as undocumented illegal entranst.

Think about that. They could save themselves from a perilous sea voyage plus thousands of dollars in people smugglers' fees if they spent another few hundred dollars to fly to Darwin, rather than get out at Jakarta. But they couldn't get a tourist visa. Why wouldn't they meet the requirements for a tourist visa under their own names - but meet the refugee requirements without ID?
Because it is a racket. Offer them asylum only and they will stop coming, these 'asylum seekers'.

But the boat people are competing for re-settlemnt with the guys sitting in camps. The refugee resttlement numbers are limited (14,000 pa). All boat arrival 'asylum seekers' want resettlement in Australia - none of them are applying for other countries. So they are jumping the asylum queue by getting here.

What would happen if Australia said it would give all illegal arrivals asylum (what they ostensibly want) but not permanent settlement, as it reserves those places for people in camps. Australia wouldbe entirely within its rights and would meet the terms every international convention.  And yet - the boats would stop instantly. Even plane arrivals claiming asylum would slow to a trickle.

The racket is to pay $10,000 to the smugglers to avoid waiting in camps for permanent settlement. That's queue jumping.

Good point, but where are you going to send them whe they stop being temporary? If they are found to be legitimate refugees, their country of origin is still a risk.

Also, people tend to marry and have kids. The kids are Australian citizens. The temps might even marry a nice Aussie lass. Why not? Tourists do it all the time.

My parents met when my father jumped ship - illegally I might add. And how did you get here, old boy?

This was reported in the media some months ago on information received from government immigration sources on interviewing these people, that many country shoppers have taken not one international plane flight from their home country, but two to get to Jakarta via Malaysia.
All done before meeting up with criminal people smugglers in Indonesia and ditching their passports etc before arriving in Australian waters.
And Navy personnel have previously reported to the media that many of these country shoppers turn up on the deck of their patrol boat with a bum bag stuffed with money.
In some cases up to $10K.
One does not need a Liberal party handbook to find this practice extremely suspicious.

I come from Great Britain where mass uncontrolled migration has turned parts of our cities into places which no longer resemble England.

Soon there will be more Muslim voters in Leicester and Bradford than British voters.

Peckham, Brixton, Edgware Rd - look more like the West Indies or Pakistan.
You are more likely to see a mosque than a church in these places.

In Australia walk through Springvale and play spot the white person.
Go through Noble Park and see groups of menacing looking Africans on street corners.

They huddle together in enclaves, they don't mix and the country's culture is diluted.

No. It is a bad way for us to go.

The Federal Magistrates Court had to abandon a hearing in Sydney this month after a man detained in Pontville, Tasmania, filed an unintelligible application by fax and appeared by telephone.

Federal Magistrate Matthew Smith directed a lawyer be found for the asylum seeker, but even pro-bono agencies were unable to locate a barrister in Sydney to take the case.

The legal firm paid for by the immigration department to prepare the man's initial refugee claim routinely drops its clients once they receive a rejection after the first review, because government funding ends at this point.

A humanitarian campaign by New South Wales and Victorian commercial law firms to fill the gap saw 40 asylum seekers last month accepted as pro-bono cases to be taken to the Federal Magistrate Court.

Katrina Ironside, principal solicitor of the Public Interest Law Clearing House, which is co-ordinating the campaign, said: "We are incredibly frustrated by this. We are asking the NSW and Victorian legal profession to do this on a pro-bono basis — but it's a government responsibility. We don't have any substantial funding for the project and our concern is we may have to stop." The clearing house is industry-funded.

The High Court ruled in December 2010 that boat arrivals are entitled to access Australian courts when the immigration department rejects a claim for refugee status.

An independent report on the impact of the High Court decision warned the federal government last year that the Federal Magistrates Court may become flooded with applications from detainees in remote locations who are legally unrepresented and therefore disadvantaged, or the lack of legal advice may deter applications.

The report, by former Commonwealth Ombudsman John McMillan, advised the government against introducing a new legal assistance scheme to cover the asylum seekers' court costs, and instead monitor the situation.

Ms Ironside said 95 barristers and 22 law firms had said they would donate their time to help asylum seekers reach court.

"It is clearly seen by the legal profession as an access to justice issue," she said.

Magistrate Smith transferred the Pontville detainee's case to Adelaide, where he now lives on a bridging visa, saying he was "hopeful that there may be an opportunity to find a lawyer in Adelaide".

The federal government will scrap the immigration department's separate system for assessing boat arrivals later this year, with the Refugee Review Tribunal to assess all cases instead.

The Greens, meanwhile, said yesterday they wouldn't support a private member's bill from NSW independent MP Rob Oakeshott to allow offshore processing in countries that have signed the Bali Process.

"Australia must continue assessing claims on shore because it's the cheapest and only legally sound means of fulfilling our international obligations to guarantee the wellbeing and safety of people fleeing persecution," said Greens Senator Sarah Hanson-Young.

The Coalition also opposes the bill.

The sensitivity in some quarters to the use of the words 'illegal' or 'unlawful' or 'unauthorised' to describe asylum seekers arriving without Australia's permission seems to have at its root vigorous attempts by some in the community to mislead the public into believing a myth that all unauthorised arrivals are asylum seekers and that all asylum seekers have a right to enter a country of choice without authority and therefore 'can never be illegal'. This is just not true. The reality is clear in international law and has been made crystal clear by the High Court of Australia.

The facts are:

    Neither asylum seekers, nor refugees have a right to enter, without authority, a country which is not their country of nationality.
    The use of the word 'illegal' or 'unlawful' to describe asylum seekers entering a country without authority is standard international practice, not least by signatory states to the Refugees Convention. This is because the Refugees Convention (Article 31) explicitly refers to the "illegal entry or presence" of refugees who arrive in the territory of a country "without authorisation".

Accordingly, describing a person as an illegal, unauthorised or unlawful arrival, or their presence as illegal, unlawful or unauthorised is doing no more than using the correct objective descriptions. As reflected in the Refugees Convention, these are the appropriate terms even where a person is found to be a refugee.

If these people were illegal immigrants, I wouldn't be too happy about the $60m per year.

3200 out of 3237 boat people surveyed almost 99% of them said they disposed of their passports before coming to Australia by boat after flying into Indonesia.

A genuine refugee would have no reason to dispose of their passport.

This $60 million a  year means over $1 million dollars per week just on legal fees,the free smokes,internet,mobile phones with international calls will add to this billion dollar debacle by labor and the greens.

The Migration act says they cannot claim asylum after their visa has expired so you are comparing apples to peanuts.

Australia is promoted as a tourist destination so we cannot be too hard on tourists who overstay.
Its pathetic how leftists deceive people by suggesting tourists who come here with a visa legally can somehow be compared to a boat person who chucks their passport away to hide their dubious past.
We  dont give handouts to those who overstay their visa they dont  even qualify  for medicare.

i like australia very much and is my host country -- they does make mistakes on refugees too as well as all people though.

You do know uncle meat,, that Israel before has asked Australian Government for details and to inspect refugees in camps because of belief of former Palestinian terror suspects wanted by security forces,,

sometimes Australia is not cooperate on this though which i dont believe is correct.

This is my only say on this topic other though as is not my position to make criticism of host nation.

1.  I'm merely presenting the facts.  The title of this thread is incorrect.  Why don't people in this forum like facts?

2.  I'm certainly not a 'soft touch' for illegal immigrants.  Send them home.

3.  However, when it comes to asylum seekers claiming their legal entitlements, I have no problem (however, if they're not granted refugee status - send them home).
