What, you mean: apart from her experience as Governor of Queensland, and her qualifications in an arts/law degree, etc.!?

Not really,  she was investigated for not taking appropriate action as Governor of Queensland during the do-called Shreddergate affair.

IN an unprecedented breach of protocol, Prime Minister Kevin Rudd refused a request from the former Governor-General to investigate the ongoing Heiner corruption scandal and explore the implications of his appointment of current Governor-General, Quentin Bryce.

Revelations of Rudd’s alleged gross breach of protocol came through Freedom of Information requests as his leaking of a private telephone conversation with US President George W. Bush was unfavourably reported internationally.

Rudd blocked the request, made on June 10 by former Governor-General Major General Michael Jeffery, a copy of which was sent to the Queen.

Whistleblower Kevin Lindeberg had been informed by Malcolm Hazell, then the Official Secretary to the Governor-General, that the matter “is being investigated’’.

But in her first act as Governor-General designate, Bryce sacked Hazell with no explanation.

The complaint to the Parliamentary Crime and Misconduct Committee (PCMC) was lodged by former union official Kevin Lindeberg in February 2008 and concerned the handling of the Heiner affair by the main corruption watchdog, the Crime and Misconduct Commission (CMC) and its predecessor body, the Criminal Justice Commission (CJC).

Attached to the application for review was a nine-volume audit produced by Sydney QC David Rofe that contains details of 68 alleged prima facie charges that he believes could be brought against public officials past and present.

The Governor-General, Peter Hollingworth, has resigned, blaming "misplaced and unwarranted allegations" for forcing him from office.

Accepting no responsibility for the events that have plunged the vice-regal office into turmoil, Dr Hollingworth said yesterday that he had taken his decision "with deep regret and after much thought".

The announcement followed the release this month of the findings of an Anglican Church inquiry critical of Dr Hollingworth's actions over a child sex scandal while he was archbishop of Brisbane in the early 1990s.

It also comes after the collapse on Friday of a civil action based on 40-year-old rape claims against him

In his first public statement on this matter, Sir David Smith, a former official secretary to five Governors-General between 1973 and 1990, said Rudd’s action was “a gross dereliction of duty on the part of a responsible government’’.

Sir David, familiar as the formally clad public servant pictured beside former Labor Prime Minister Gough Whitlam on the steps of Old Parliament House on the day Whitlam was dismissed in 1975, is recognised as an authority on the Australian Constitution.

This is how the Govenor-general is appointed. If you got any trouble with it matty take it up with your local member.

I think people should have a say on who becomes our Governor-General


The Governor-General is appointed by the Queen on the recommendation of the Prime Minister of the day. The Prime Minister doesn’t have to consult The Cabinet, the Government or Parliament on who he or she wants as Governor-General.

After the 1987 federal election Hawke the Prime Minister at the time, offered Hayden the post of Governor-General to give him a dignified exit from politics and some consolation for having denied him the chance to become Prime Minister. The Queen of Australia's appointment of Hayden as the next Governor-General to succeed Sir Ninian Stephen was publicly announced in mid-1988, and Hayden immediately left parliament and severed all connections with the Labor Party. He assumed the post in early 1989, Bob Hawke never consulted anyone about the appointment of Bill Hayden to the post of Governor-General.

Except in rare cases, the Governor General only acts in accordance with constitutional convention and upon the advice of the national Prime Minister. The Governor General is still the local representative of the sovereign, and performs the same duties as they carried out historically, though their role is almost purely ceremonial. Rare and controversial exceptions occurred in 1926, when Canadian Governor General Lord Byng refused Prime Minister Mackenzie King's request for a dissolution of parliament; in 1953 and 1954 when the Governor General of Pakistan, Ghulam Mohammad, staged a constitutional coup against the Prime Minister and then the Constituent Assembly; and in 1975, when the Governor General of Australia, Sir John Kerr, dismissed the Prime Minister, Gough Whitlam. In principle, the Queen could overrule a Governor General, but this has not happened in modern times. Like the Queen the Governor-General keeps out of all political debates. The Governor General was also the head of the armed forces in his or her territory and, because of the Governor General's control of the military, the post was as much a military appointment as a civil one.

Bismarck once compared the making of legislation to the manufacture of sausages – it was necessary if people had to eat, but fairly unpleasant to watch happening. The same might be said for the manufacture of partisan “news” – but watching it occur can be quite fascinating.

In yesterday’s Crikey, David Flint has put the workings of the story factory on display for all to see:

   Piers Akerman has stepped up calls for federal action over the Heiner scandal. Saying Kevin Rudd has opened the way for a further inquiry, he argued on The Insiders that this could be “a very serious sleeper” in the election. Andrew Bolt mentioned this in his blog, and Alan Jones has discussed it at length. Michael Hodgman told the Tasmanian Parliament it was discussed recently at a meeting of shadow Attorneys General. When Piers Akerman concentrates on an issue he can be singularly effective; just recall what he did to the Kirner government.

It all sounds very cosy when put like that. Though Akerman might like to adopt the persona of the lone crusading journo on a fight for justice, the apparently co-ordinated or at least serendipitously spontaneous push by shock jocks, Liberal MPs, and right wing columnists to talk up a confusing and convoluted story about an inquiry held in 1989 and six subsequent inquiries into the destruction of the documents from the first inquiry by the Goss Government should ring some alarm bells.

It’s surely risible to suggest that the Heiner affair will be a sleeper in the election, as Akerman must know. What he really means is that a bunch of politically motivated “insiders” would like to talk it up to score some hits against Kevin Rudd.

The 1989 “scandal” had already been raked over by the Coalition Borbidge government after Goss’ fall, and there’ve been attempts to stir its embers aflame almost every time a federal election approaches. Now we see a bunch of elderly QCs and retired judges offering portentous “opinions” which fuel Akerman’s crusade. The fact that they’re all so exercised by a putative miscarriage of justice which has the potential to cause Kevin Rudd electoral harm is presumably coincidence, and not in the forefront of these distinguished and learned legal minds.

Arguably, whistleblowers who’ve lost all perspective after the harm done to their own careers are being used in this push. Rudd has played a straight bat to the confected furore, but what is more deserving of enquiry is why this total non-story is being written about using rhetoric as hyperbolic as the phrase “a stunning reversal” to describe a comment by a Rudd staffer. Andrew Bolt gave the game away in his blog when he wrote:

   Piers Akerman says there is something fishy about the destruction of documents relating to a pack rape of a girl in state care - and very senior legal figures agree. Kevin Rudd won’t like Piers mentioning his connection to the government which did it.

This whole crusade is designed to generate headlines linking Rudd to child r-pe. Bolt proceeded carefully and wrote that he didn’t “know what weight to put on this”. He could, of course, find out by reading the tedious and confusing voluminous documentation on this issue if he liked. But, very few will.

If Akerman’s crusade succeeds in pushing a near incomprehensible piece of ancient history onto the election agenda, there could be an interesting case study in media and legal ethics for enquiring minds to ponder. And, perhaps, in the politics of media smears.

Digging deeper into Kevin Rudd’s past

Kevin Rudd must have been grateful for Peter Beattie’s remarks on Insiders yesterday (though Glenn Milne probably wasn’t).

Beattie has been working to lower the temperature of the local government front of The War on the States, declining to sack or fine Councils which went ahead with polls, and releasing his own government polling showing 73% of Queenslanders support the amalgamations. He also executed a characteristic “listening to the people” backflip, warming to the idea of plebiscites. Beattie’s bet is that the heat will go out of the issue, while John Howard moves on to executing his next rabbit-hat pulling stunt. Howard will no doubt be busy denying that he has any opinion on strip clubs.

But there’s some more Queensland murk being stirred up that might be designed to further muddy the waters for Rudd.

Perhaps not wanting to be overshadowed by his News Ltd colleague Glenn Milne, Piers Akerman has been dredging up a really old story – the Goss Cabinet’s order to shred documents compiled by retired Magistrate Noel Heiner in 1990.

Heiner had conducted an inquiry into allegations of child abuse, neglect and r-pe at the John Oxley Youth Detention Centre. The inquiry predated the election of the Goss government in 1989.

To put it mildly, it’s a confusing issue. It probably would need the Royal Commission Akerman calls for to make any sense out of it. Without wishing to be too unkind, some of the whistleblowers at the time may have become a tad obsessed about what to everyone else is ancient history. Googling the Heiner inquiry reveals websites that reek just a little of conspiracy theories – including some that lash the media for not highlighting One Nation’s bold role in exposing the truth.

It’s worth observing that the then Criminal Justice Commission investigated the shredding and absolved Ministers of any impropriety. Goss argued that the solicitor-general advised him that the inquiry had not been constituted properly by the previous National Party government, and that the shredding of the records was necessary to protect witnesses from liability for defamation. That was accepted by the CJC.

It may well be that there are still genuine issues and unresolved matters of justice to be dealt with. But it can’t be coincidence that interest rises in this ancient affair regularly before federal elections. Bronwyn Bishop, for instance, discovered a passionate concern about the Labor Party’s alleged iniquities in the Heiner shredding in August 2004. Akerman doesn’t note that the matter was also the subject of a report by the House of Representatives Standing Committee on Legal and Constitutional Affairs, which Bishop chaired.

The cynical might conclude that Akerman may realise that his article could spark headlines linking Rudd’s name to child abuse and r-pe allegations. Surely the crusading journo knows that there have also been no fewer than three Senate reports into the Heiner affair.

Of course, there’s no evidence that Rudd had any involvement in the issue. But as I wrote in Crikey back on 12 January about Rudd’s desire to present himself as the prime mover behind the Goss government:

   The politics of Rudd’s record in Queensland will continue to play out in the lead up to the election. It might well be a net plus, but there’s also some danger for the Labor leader in highlighting his previous experience. One thing is certain — there’s a lot more on that record than there was in the case of a certain former Mayor of Liverpool.

A COALITION of right-wing extremists and conspiracy theorists has been identified as the driving force behind moves to revive the so-called Shreddergate affair as the federal election approaches.
Queensland Nationals senators Ron Boswell and Barnaby Joyce were told by government leaders not to proceed with plans last week to table in the Senate a 3600-page report by Sydney QC David Rofe on the Heiner inquiry in Queensland in 1989 and 1990, known as Shreddergate.

The report identified 67 possible breaches of the criminal code by Queensland cabinet ministers and public servants over the 1990 shredding by the Goss government of documents compiled by an inquiry headed by former magistrate Noel Heiner into Brisbane's Oxley Youth Centre.

Several investigations have dismissed claims of a criminal cover-up.

Mr Rofe told The Australian last week that Opposition Leader Kevin Rudd, chief of staff to premier Wayne Goss at the time of the shredding, was perceived as "the man we are after".

An internet website devoted to Shreddergate is maintained by former One Nation webmaster Scott Balson in co-operation with Kevin Lindeberg, a former union official who first raised allegations of a cover-up of sex abuse at the youth centre in the early 1990s.

Others whose controversial views have been published by Mr Balson on his internet sites include veteran American neo-Nazi William Pierce, prominent Holocaust denier Bradley Smith, One World conspiracy theorist Peter Myers, and League of Rights chief Jeremy Lee.

The conspiracy theories included a baseless claim of a plot by businesses to poison the public through an artificial sweetener in Diet Coke.

Mr Balson denied yesterday that he was an extremist. He said he had a responsibility to keep Shreddergate in the public eye. "I have kept the Lindeberg webpage open since 1997 and will continue to support him because his fight is for justice in a corrupt system."

The anti-Semitic League of Rights is another vigorous supporter of Mr Lindeberg.

An August edition of the league's newsletter, On Target, carries an article headed: "Long Running Suppurating Sore - The Heiner Affair". The newsletter reproduced parts of a column by journalist Piers Akerman, of Sydney's Daily Telegraph, who will appear at a public meeting with Mr Lindeberg in the NSW parliament next Tuesday.

Shreddergate has been embraced by Rural Action Movement head Selwyn Johnston, an independent candidate for the north Queensland seat of Leichhardt, who has organised speaking tours by Jeremy Lee.

Mr Rofe declined to comment yesterday on how he became involved with Shreddergate.

The Opposition Leader's critics, including senior Liberal and Nationals politicians, have claimed that the evidence was destroyed when the Goss Labor government in 1990 ordered the shredding of documents compiled by an inquiry headed by former magistrate Noel Heiner into Brisbane's John Oxley Youth Detention Centre. At the time of the shredding, Mr Rudd was chief-of-staff to premier Wayne Goss. His critics claim that Mr Rudd would have sanctioned the shredding and that as a result, the alleged rape victim was denied justice.

But Mr Heiner was commissioned to investigate the administration and operations of the centre, and has said since that he has no recollection of his inquiry examining the rape case.

Sorry....living in WA makes me a little ignorant of the Eastern States.....I still cannot see why Kevin Rudd would be held accountable for following directions from his boss....However the fact an inquiry did not look at the rape and only looked at government complicity stinks of political opportunism.....This whole affair is about trying to attack the credibility of Kevin Rudd not to achieve justice for this young girl!!!
