A mother was jailed for two years yesterday for crying rape against a man she met on a dating website.

Jennifer Day, 34, who made the false allegation against former boyfriend Andrew Saxby after a row, was told by the judge that she had undermined efforts to treat genuine rape victims fairly and sympathetically.

The court also heard that Mr Saxby was subjected to 'degrading and upsetting' examinations while being held by police for ten hours.

Judge Ian Graham said the investigation had wasted £4,000 of taxpayers' money and 270 police man hours.

He added: 'The police have put great stores on providing sympathetic treatments of women who make genuine complaints of rape and you abused that.

'You have undermined and jeopardised the efforts that are being made about the need to treat genuine victims of rape properly, fairly and sympathetically.

'The offence is in itself a serious one, it has terrible consequences potentially and actually for the victim and wider implications for those women who have genuinely been raped.'

Day, a former nurse, from Corringham, Essex, split up with the father of her four-year-old daughter in 2007 after he had an affair with their lodger, Basildon Crown Court heard.

She began drinking heavily to cope with the rejection and using dating websites. In September 2007 she met Mr Saxby, who worked for the Ford car company, through the Dating Direct website.

They began a relationship, but the court heard that she was also seeing another man.

In January last year, the couple rowed after Mr Saxby accused her of having another man at her home. Afterwards, Day dialled 999 and accused Mr Saxby of rape.

He was arrested in front of his colleagues and taken to the police station.

Judge Graham said: 'It was an extraordinary performance which involved deliberate untruths as the jury found.'

The court heard that Mr Saxby was released without charge after Day dropped the allegation, although she still maintained it was true. She was found guilty of one count of perverting the course of justice last month.

During the trial, the court heard how Day had a history of making up stories. The jury was told that while working at Royal London Hospital in East London as a nurse, she suffered stress-related hair loss and led her colleagues to believe it was cancer.

Rebecca Lee, mitigating, said Day had been under a lot of strain following the break-up of her relationship with the father of her daughter.

She said: 'She got involved with dating websites and going out when her daughter was staying with her former partner, going out to pubs and engaging in what she would call risky behaviour and behaving totally out of character.'

Day apologised unreservedly for the allegation, the court heard.

But the judge rejected calls to suspend the sentence.

'Mr Saxby is a completely respectable man who had formed a relationship with you and had shown considerable affection and kindness of the kind you said you craved,' he said.

'His reward was to be the subject of this completely false complaint.'

Day burst into tears as she was taken down to the cells.

The case will re-ignite calls for alleged rapists to be given anonymity until a verdict is delivered.

While anyone who claims to be a victim of a sex attack is given anonymity for life, someone charged with rape or sexual assault can be immediately named.

Even if the allegations are ultimately proven false, those accused often find their lives turned upside, and find their reputations still suffering even years after the claim.

Some have found themselves shunned by their family, friends and community, others have lost their jobs and homes or found themselves the victims of vigilante attacks.

One recent victim of false claims said he felt like killing himself during a 'year of being told I'm a rapist'.

The conviction rate for genuine rapists is low in Britain - just one in 14 cases reported to the police end in conviction - and false accusations will do little to improve what ministers have called a 'culture of scepticism' towards genuine rape victims

The courts have begun to recognise the trauma suffered by those who are falsely accused, with one taxi driver whose 'life was ruined' by false claims expected to receive a five figure payout, while a former magistrate who spent two years in jail on false rape charges is currently suing his accuser for £300,000.

However victims of false charges say the law needs to immediately grant accusers anonymity until proven guilty.

On a lesser scale, Matthew Johns has had his career ripped to shreds even though all evidence points to his accuser being nothing but a liar trying to cover up the regrets of her past. She's shown that she hasn't advanced as a person in the least, in fact, if it's at all possible, she's gone backwards.

Tallow - you sound like a woman hater. I bet more women are murdered each year by their partners, than the other way around. Of course some women tell porkies - "hell hath no fury like a woman scorned", but men are much more dangerous, aggressive and violent when they're angry than a woman.

Besides - people who lie usually get caught out in the end and punished, but a dead person can't be brought back to life.

You and i, are obviously looking from very differing perspectives, at the things we both see in this world.

In posting that image, you [claim you] see me denigrating women.

I see a piece of modern art, which i presume, the artist created, with the intention, of stimulating peoples brains cells.

I think that the artist succeeded.

It obviously depends on viewing angle though some art lovers say that to really appreciate a sculpture it needs to be touched.

There's the irony yet again. Mantra instantly sees that statue as an attack on women.
How can there be justice when this type of attitude becomes the norm?

That statue isn't about demeaning women, it's a swipe at the justice system in general.

All too often we hear of women who have premiditated a cold callous murder of their spouse, plotted for weeks/months even years.
These women claim that they haven't had the chance or consideredd going to the police, yet alone even to simply leave.
But yet they have been able to obtain a rifle/shotgun and planned the murder.
They even confess, yet they don't get gaoled instead they are allowed to walk free to kill again.

Meanwhile the victim can't speak about what really happened as he has been murdered.

The usual response from a manhating fem is to accuse/label anyone who criticises society, the justice system, the media for the favourable bias given to women as a woman hater.
As afterall they don't want the special red carpet treatment that women are given in abundance to be diluted in any way.

There's such a fine line between "rape" and what males call "consensual sex" - a jury or judge has to decide who is telling the truth.

Do men get two years gaol for rape? Often they get off on a good behaviour bond.

For God's sake - it was only a comment and when males refer to females emasculating them - obviously females will respond.

Thanks for that information brat - I wasn't aware the penalty was so severe, but I would assume that would be for serial offenders or where violence and injury was inflicted.

You may not think the issue of rape is serious or those falsely accused of rape is serious.
But it is!

And whether it is a genuine once off or serial offence the accused still gets a decent sentence (obviously the seriel offenders get longer still).

Shame that all sex offenders aren't treated the same.

Didn't you just accuse me of being a male hating feminist? You're contradicting yourself a little.

There is a Yin & Yang version of all aspects of humanity, although various cases manifest themselves differently as interpreted by the sexes. For example, the female version of a wife basher is often the soul destroying emasculator, and best kept away from, left on the shelf. Although conditions of most cases are largely universal, eg. a good woman or man needs to be honest, loyal etc. some conditions are interpreted by the sexes.

Yes it depends on the aspect you take.
Like you hear of the partner who is jealous or the partner who is smothering and controlling whilst the other is allowing them to do what they like, doesn't notice them and can be seen as not taking any interest or concern.

Whilst we tend to take a blind eye to the husband bashing and seek some sort of justification for violence.
There's no justification for the violence.
Tiger Woods did not deserve to have his head belted in with a golf club nor did Nicole Simpson deserve to be killed.
Both were apparently philandering but the outcry and fathoming of the reasons is quite remarkable.
In both the guilt was attributed to the husband and was interesting to see the attempted justification for Nicole's philandering so where is the same for Tiger? If OJ caused Nicole to wander then Elin Nordegren caused Tiger to wander as well. If OJ was violent then so to was Elin. Sure Nicole was murdered but Tiger could also have been killed, so where's the attempted murder outcrys?
Remember there's no justification for these violent acts!
