OzPolitic values the privacy of all members. Do not post personal information about other members without their explicit permission. This includes the contents of personal messages

If they posted personal information from months ago and I recalled it and referred to it at a later date, and they got upset, is that the same?

Or is it their own foolish fault?

Easel, if you get arrested:

1. Say NOTHING, no matter what they tell you, NO MATTER WHAT. Whether they say, 'It will be easier on you blah blah...' Nothing. Give them your name, address, and hand over your ID and possessions. Be nice and say 'Look, I'm sorry guys, but I'm not making any statements today. And would it be possible for me to call my lawyer please?' Just keep saying that, in a nice but persistent way. Don't be a smartass, and don't get angry with the cops, or be intimidated by them. They might try to say 'Oh for this offence you have to make a statement, and we can charge you with hinder police for not doing so....' just say,  again, 'Well I'm sorry guys, I'm not making a statement, can I please call my lawyer?'

2. Call your lawyer. Remember that they are probably listening to what you tell your lawyer, so just say, I've been arrested, can you come down and see if you can arrange bail for me please?

3. Do not even consent to a statement, to say that you don't want to make a statement. You have the right to silence, so use it.

Its amazing how many people stuff that part up, when its on all the tv shows, and on all the movies.

But confession is so much better for the soul.

I always say, just tell the truth, if you have done nothing wrong, you have nothing to fear.

The police are not our enemies, we should try and help them, not waste their time.
They are not trying to trap innocent people, so innocent people have nothing to fear from the cops.

However, if you are guilty, they will catch you, sooner or later, so pissing them around in the short term will not do anyone any good.

Boy you are cynical Calanen.

I know more than a little about the law, and I do not think that cops want to persecute innocent people, and I don't know if the link you put was from that US law professor, but I assume it is, because I have seen it before, and it may have some merit, for guilty people, who live in the US, to follow your advice, but innocent aussies don't need to worry, our cops are good.

Seriously, they don't arrest people without evidence, and if they have evidence, they don't need your co-operation, to secure a conviction, so you just make a goose of yourself, for nothing.

If you do the wrong thing, and get caught, then just try and face up to the fact you made a mistake, and try not to do it again.

I know a few police who would not be impressed with someone being a smartarse over something trivial, and making them waste time on something that would just bring a fine at worst anyway, so why make enemies with the cops, who are just trying to do their jobs?

You do? How about that - me too. I have the degrees and licenses on the wall to prove it. Its actually what I've done every day for the past 10 years or so, in three different countries.

You didn't watch it then - because he said that if you are innocent you shouldn't talk to the cops, and quotes from the US Supreme Court who says the same thing. He also hears from the Sgt in the Virginia Police Dept, and was in the Navy as an investigator. And he agrees with the Professor.

Which cops would they be? The Feds? ASIO? NT Police, ACT Police, NSW Police, SA Police, QLD Police, WA Police? Tasmanian Police? Royal Commissions into Police Corruption in both NSW and Queensland? You've met, dealt with and know them all? You sure get around then. I've dealt with all of them except for the SA Police.

Can you tell me what the relevant difference between US law and Australian law and US police and Australian police is? There is no relevant difference.

mozzaok - last year I had an experiecne with the law that leads me to agree with calanens comments in the main.

The westminster system is an adverserial system.
It is the cops against  whoever they can get.
They do a GREAT job and have my 100% support, but if I am questioned, they are NOT on MY side.
They are legally against me.

I have and will do all I can to assist them.

Better still, ask if you can PM Counsellor Calanen from Ozpolitic...

It'll be like a movie... The camera will fix on the cops turning to each other with that pained look... they've dealt with Counsellor Calanen before, their knowing glances will imply... Then the scene will flash to a court room in the past... Counsellor Calanen staring down the police prosecutor, his arm outstrecthed, finger pointing at him growling "Go ahead... Break my case"...

I have seen the clip in question, and as I said, if you are in the US, and you are guilty, then it makes a lot of sense, but keep in ,mind, the point of the exercise was that he was a law professor, making a point to law students, that is all.

If you want to try out Calanen's advice(already not wanted in two other countries ;D ;D ;D), then I certainly won't stop you.

One of my best mates told me that 5 years of Law at Uni and another 10 in practice boiled down to two simple things.

Admit nothing.

Deny everything.  :-X

Easel, private correspondence is just that. Information should only be revealed if it involved harm to someone.

hi locutious, and yes, of course, in principle, it is true what you say, but the reality is more as I describe it, ask any copper.

I was just pointing out the facts as I know them, and to prove yourself a liar in interview, would not bode for pleasant interaction, sometimes the best advice, needs to be tailored to the circumstances at hand.

Mozzaok, I may have missed a Post/s, but where is it established that (a) Calanen is a lawyer and/or Solicitor/Barrister admitted to practice in all or any one of the States of Australia, and (b) he was not able to be admitted to practice in two other jurisdictions?

I have said what I want to.  I always do, and in quite plain unequivocal language.

You cannot claim the same.
